Delay Beyond 30 days from original DROS

    Original DROS transaction: 10/17/14

    DROS Delay notice: 10/26/14

After my DROS was delayed, my research led me to AB500.

    AB500 in part reads:

Today is day 31 after the original DROS transaction. When I called to inquire about my DROS status I was informed by my FFL that it hasn't updated and that the 30day time frame starts from the DELAY Notice.

Was I reading AB500 incorrectly? Is it 30 days from DELAY notice?

The delay notice that the DOJ sent in the mail is pretty vague about time frames.

      The letter is dated 10/26.

      The letter reads in part:
Regardless, the Department is required to make it's determination within thirty calendar days. If the Department is unable to make a determination in this time, the dealer will be notified and may deliver the firearm(s) to you at his/her discretion.

The DOJ , in the letter, does not reference whether the "30 calendar days" is from the date on the letter or from original submission of DROS.

As I mentioned yesterday - Have your ffl contact doj and they can update. Someone is behind.

I had this EXACT situation happen for a customer. I called in and they updated the DROS that day so I was able to release it to the customer. They told me the person who releases the delay had fallen behind in workload.

Well it looks like I'm at the mercy of my FFL. It appears that he is confident that the 30 days is from the delay notice. He doesn't seem motivated to contact the DOJ to ask for an update to the DROS even though I mentioned it. I don't want to be a pest so I'm going to bite my lip and wait it out. Today is day 32 from the original filing. In another 8 days 11/26 will be 40 days (and the day before Thanksgiving). My FFL will be back from out of state holiday travel on 12/2. I'll get my firearm then. 46 days after original DROS filing.

I'll chalk it up as a learning experience and choose my FFL much more wisely in the future.

FYI - I thought it was from delay date as well, but I bothered to check on behalf of my customer which is when I learned it was from DROS start date, etc..

I really appreciate that FFL's like you take the time to come here and help address our concerns as buyers (even when we aren't your buyer). You supply very valuable information based off your experience, on your own time and free of charge. I'll keep that in mind for my future needs. Much appreciated!
