    10-day wait and C&R Handgun

    Strange thing happened yesterday. I have my C&R FFL03 and California COE, and my understanding was that when I transfer a C&R handgun via FFL01 dealer, I am still exempt from a 10-day wait, according to PC 26970. So yesterday I was picking up my C&R revolver and the dealer was trying to find a "Collector" option on the DROS form, and it was not there! I'm looking at the DROS user guide, page 46: http://oag.ca.gov/sites/all/files/ag...try_guide.pdf?
    where it says Waiting period exemption, and it lists four options.
    Does anyone else here has the same issue? Did DOJ quietly change that and removed this option?
    I smell a big stinky lawsuit...

    Don't know how it works on the DROS but I just got an FFL03/COE wait exemption Friday.

      I just picked up 2 handguns. The dealer marked them as C&R then entered COE + 03 exemption and it allowed him to release them immediately.

      Is it possible your 01 didn't mark the handgun as C&R?

      Look at page 46 on the file you linked..




      I've heard rumor that it's "broken" for PPT, though.

        The waiting period exemption for a Collector is missing for a PPT. One work around would be for the FFL to just receive the firearm, like with it being shipped, then do the DROS as a normal transfer. The fees would not be limited by law, but it would still be exempt from sales tax (a letter should be written that it is an occasional sale from a private party). The FFL might honor the PPT fee, but you would have to ask. You should also get the FFL to report the problem.

          Well, I do know about PPT (had this issue a few months ago), but this one was out of state transfer, the gun was shipped to FFL and he started the DROS as Curio&Relic Handgun Sale, and we both looked at the form and there was no Collector option...

            The Collection exemption is there now for a C&R transfer.

            The response from the CA DOJ regarding the PPT missing the exemption is that they know about it and to call them:

            Thank you. We are aware of the situation and we are working on a fix. In the mean time, please call (855) 365 - 3767 for more information on how to DROS the PPT for a C&R FFL holder.
            I requested it in writing, for some odd reason :-).

              Has anyone received the info on how to do this? I did not call and now I need to do it. The DES is not answering their phone and they refused to put it in writing.

                I talked to the person at the DES and they said that the person has to wait the 10 days. With the recent court case about the waiting period, that is quite interesting.

                  Well, I went to that store again a few days ago and asked the dealer to try to start the DROS again. Sure enough, this time the Collector option was there and he was able to release the gun immediately. I could swear that it was not there when we tried for the first time. Really really strange.
                  As far as PPT, I was told that it has to be started as C&R Sale regardless of whether it's a PPT or not.

                    It was not there in the past.

                    The PPT needs to be fixed and the attitude of the CA DOJ needs to change. It is really not acceptable for them to say that the person needs to wait the 10 days in order to do it as a PPT. Yes, it can be done as a non-PPT, but then the fees are not limited, if the buyer is prohibited, then the seller would need to DROS it back. It is a plus if both the buyer and seller are prohibited though :-).
