    1 in 30 violation when it wasn't

    We got a 1 in 30 violation today and the DOJ is wrong and will not help nor listen to us.

    Customer DROSed on 10/6/14 @ 9:47pm
    Latest delivery is 11/5/14 @ 8:47pm (time change)

    We DROSed him again on 11/5/14 @ 8:55pm

    DOJ says it is in a 1 in 30 violation but they are not accounting for the time change.

    Anyone know of a way to challenge this or am I wrong? If the CA DOJ doesn't use Daylight Savings then how is that our or our customers fault?

    There are 31 days in October.

    so they accounted for the time change when showing when the latest deliverly time was? they were able to calculate 720 hours for when the DROS was valid but it is a different 720 hours for the 1-in-30 rule?

    so, did the DROS look like this?
    dros started 10-6-14 9:47PM
    earliest pickup 10-6-14 9:47PM
    latest pickup 11-5-14 8:47PM

    if so, it is pretty obvious that they were accounting for the time change in the 30-day validity of the DROS. I know I have mentioned this in the past on the forum asking about how time changes might adversely affect dealers and customers.


    at least it happened at a timeframe when it shouldn't cause the customer to lose an SSE slot.

        Found the OG bulletin

        This is to notify you that effective January 1, 2000, the Department of Justice (DOJ) will begin screening all handgun transactions to ensure compliance with Assembly Bill 202 (Chapter 128, Statutes of 1999). This new law prohibits California firearm dealers from selling/transferring title of any handgun to any person who has already acquired a handgun within the State of California in the past thirty (30) days. This law has been incorporated into California Penal Code (PC) sections 12071 and 12072.

        DOJ will reject Dealer’s Record of Sale (DROS) applications submitted by any firearm dealer when it has been determined that the purchaser has completed a handgun DROS application that has been accepted by DOJ within the past thirty calendar days. In computing the thirty day period, the date the DROS application is accepted for processing by DOJ shall count as the first day. As a reminder, a DROS application has been accepted for processing by DOJ when a DROS number has been assigned by either the DROS Entry System (DES) point-of-sale device (PSD) or when MCI issues a DROS number over the telephone for an application that has been processed through the DES telephone call center.

        DROS rejections based on violations of the thirty day restriction will be handled in the same manner as a DROS denial/cancellation. Accordingly, DOJ will notify the dealer of the DROS rejection by both telephone and U.S. mail. Those dealers who have been assigned a PSD will receive an additional notice via the PSD e-mail notification system. In such cases, the dealer will be advised that the rejection is based on a violation of the one handgun per 30-day limitation imposed by PC Section 12071.

        It appears that the law was written into PC 12071 that it is 30 calendar days not 720 hours.

          Had this happen yesterday and sent copies of the DROS to the DES help desk and they cleared the reject.

          It happened again for someone else today and I just sent them copies again. Pretty sure they will clear this one as well but have not heard back yet.

            Called again and got someone helpful, said she will be calling me back.

                I also have been doing some within a few hours after previous DROS "latest delivery date" and have not experienced issues.

                    If you DROS a firearm pistol from 1953 (shipped from out of state) do you still have to wait 30 days to do a PPT on a modern pistol? Sorry to high jack. I admit. But, you guys are professional and probably know the answer quick enough
                    Brown 3 million. His opponent 2.1 million. Gun owners 8 million. Shouldn't his opponent have received 8 million and we have a pro gun governor??

                      No, PPTs are exempt from 1-30. You can PPT as much and as often as your wallet allows for ANY type of firearm.

                          We have had 2 so far as well. The first one, the DOJ cancelled the DROS and in the letter approving after Denial, they said a new DROS was required and that in the comments section to note the old DROS number so that we wouldn't be charged twice for DROS.

                          The Approval after Deny is still a major pain in the ***** as it requires the RE-DROSing of a perfectly legal transfer that, as a result of the DOJ's inability to handle the Daylight Savings Time change, is the completely legal and properly documented transfer.

                          The proof is in the Latest Delivery Time listed on YOUR DROS COPY. Apparently, the soccer moms that are working down there haven't quite received the memo, that the IT guys probably never sent, about the fact that Daylight Savings time ( unlike Global Warming/Climate Change, A Conservative Gun loving DOJ, ETC.) is a very real thing that gun buyers live by.

                          Sheesh, as I was typing this another denial due to" the missing hour" just popped up. Grumble Grumble Frick a fracka ARRGH!!!!!

                            it almost sounds as if the computers are time stamping the DROS beginning, earliest pickup, and latest pickup on UTC, which makes sense on a programming point. but why wouldn't the 1-in-30 check be running on that same UTC timeframe? could they actually be visually checked by a DOJ staffer?

                              I believe so. I spoke to "Vickie" there and she didn't see the previous time stamp on our physical copy. She is probably reading an excel spreadsheet type program that (when her computer updated to Daylight savings time) doesnt show the same time as the printed DROS . We are having to prove it to her each time. . . . .
