    DUi

I was wondering if an employee gets a DUI, what's the legality of them working at a gun shop.

Unless it's a felony or he drives for you I see no issue.

It would also depend upon the sentencing conditions upon conviction.

Seems some judges as a condition of any probation add weapons restrictions. He needs to make sure his lawyer tells the judge his continued employment depends on no such restriction.

I haven't seen weapons restrictions as a condition of DUI probation. Can't say it doesn't happen, though. Depending on the judge. Most do think they're god in their own courtroom.

It's a simple misdemeanor; not a crime of violence. It's informal. You pay your fines, do your classes, get your license restriction for a while and life goes on.

To go a step further, if he/she has a CCW the conviction might well violate the conditions under which he/she obtained and retained the CCW status.
If that is the case and the CCW status is revocable, you would have a decision to make as to whether he/she should (1) carry on your premises, if you allow that (and many shops do allow their employees to carry), and/or (2) handle firearms within your business.
It's that nasty word, LIABILITY... It's going to be a tough call.
Again, it all depends on the conditions set down by the court. If you have an attorney on retainer it might be a good question to pose to him/her.
