    Deceased parent's firearms

    Hello all,

    I've read the stickies and have searched the forum, and haven't found the answer i need, so I hope you all can help.

    I have a friend whose father died at the end of the spring from cancer. Late last year, the father "gave" his firearm collection to my friends brother. And by gave, I mean he handed over the keys to the safe, said "they're yours now, take care of them," and that was the end of it. The collection included rifles, shotguns, and handguns.

    They've been busy up till now fighting the cancer and dealing with emotional and financial issues, so the gun collection issue was pushed to the wayside.

    The shotguns and rifles should be fine, as they were given before 2014. The handguns i'm stumped on. From what I've read, intrafamilial transfers don't apply to handguns. Do the handguns now belong to the deceased's wife? Can you even do a volreg if they're still registered to the deceased?

    They asked me, and I don't know. What should I tell them?

    This is assuming that all parties involved are CA residents...

    Person A = Friend's father, who is deceased.
    Person B = Friend, who is the son of Person A.

    1. Person A gifted his firearms to Person B.
    2. Since Person A and Person B have a parent-child relationship, this is an intra-familial transfer.
    3. Person B takes possession of the firearms and reports them via Report of Operation of Law or Intra-Familial Firearm Transaction.

    If the transfer took place before 01-01-2014, then only the handguns need to be reported.
    If the transfer took place after 12-31-2013, then all the firearms need to be reported.


    If not everyone involved are CA residents, then it gets complicated.

        Additionally, Person B must have a valid CA Handgun Safety Certificate.

        (I do not know if the HSC requirement has any exceptions i.e. LEO or CCW Permit holders)
