FFL please help

    FFL please help

    So I bought a Handgun on Gunbroker. It turned out to be a PP and in California. But its still like 8 hours from me. I went to my FFL and he said the guy needs to take the gun to a FFL and have it transferred to him. I explained this to the seller and he said hes never done it like that. He said he just mails it to my FFL with a copy of his DL. So now we are going back and forth.

    To add to it Im to send him 1500.00 for the gun in the form of a MO. So I just want to make sure everything is done right.

    Any advice?

    Is the handgun currently on the roster?

      No law requires it be sent from an FFL only that it be received by one. Some dealers, however, make it their policy to only accept firearms from another FFL.

          I don't understand why an FFL would care who the firearm comes from. I accept shipments from private parties and dealers alike. Is there a good reason to not accept private party shipments?

              Not if your FFL has already told you he won't accept it from a non-licensee

                Yes but most should know the law and if its ok then its all good.

                This shop is a little slow if you know what I mean.

                  Nope, if your shop said no private shipments that's the end of it. Find another FFL or have it shipped license to license.

                    +1 -- if you don't follow their policy they'll just reject the shipment and you'll be out even more time and money.

                    EDIT: If you're anywhere near Fremont, CA we accept from private parties.

                      just because the law allows for them to accept shipments from non-licensees, doesn't mean that it is OK for you to just ship one that way without their approval. many FFLs only accept shipments from other FFLs, not because they think the law requires it, but because they think it is safer that way. They aren't receiving a shipment where they have to worry about if there is proper documentation in the box. if there is a problem and they ahve to ship back, can they just ship back to the seller (federal law doesn't seem to allow for direct shipments back to a seller to unwind a deal) where they can always ship back to the original FFL. and for other reasons as well.

                        PPTs also must have both parties present. If not is treated as an online purchase.

                        As for only receiving from dealers, if it is shop policy it is shop policy. Think of it as Federal law and CA law. Fed law says nothing threaded barrels on handguns but CA laws says it a crime.

                        If you dont like their policy, find a new shop or sweet talk the manager or owner.

                          I dont want to bent any rules. I just want the seller to know Im not laggin on him.

                          I havent found a shop yet and he seems stuck on just sending it.
