    2nd hand dealer permit / FDAS

    I let mine expire because we didn't do enough...

    however, the questions I have are:

    Why are FFLs required to be registered as 2nd hand dealers when we purchase a rifle or pistol for resale from a local private party in California?

    How is that different than buying a firearm from a guy 200 miles away that you can't get a thumbprint for or from someone out of state?
    Furthermore from a logbook standpoint why is that treated differently than processing a transfer from a private individual that ships the firearm to you?
    Would you need a secondhand dealers permit to go to a Nevada pawn shop and purchase a clearly used gun for your inventory and then re-sold in California (no)?

    So, what's really the purpose of the FDAS system in these cases?

        Almost none!! It's just another "Tax" for local government entities.
        Not exactly the same vain, but the same principal: Why is CA requiring the owners of 2011 and later diesel F-350's, etc. to get a smog certificate when there is no smog test for those vehicles available??? I just paid $65.00 for a piece of paper and no test was performed!!!!!!!!!!!!!!!

        I feel better now...

          I just made out my $300 check to the DOJ for my secondhand dealer license renewal. Are you saying they give that back to my local PD?

            Nah, I'm saying that I didn't remember paying it .. Maybe depends where you live. I got a 2nd hand dealer's permit from my local PD and paid them $200-300. I don't remember paying CA DOJ anything. They just asked to see my permit before they'd give me an FDAS. This was about 19 months ago so I could be forgetting too...

            In any case if it was about the money you'd think the DOJ would force any used pistol to go through the FDAS process and not just ones from local private consignment/acquisitions.

              One aspect is like a pawn shop where they want a chance to check to see if the item was stolen.

                But why wouldn't they want to check if I purchased a gun from a private guy in Los Angeles and he shipped it to me.. why do they only care about stolen guns from a local guy that comes into my store to sell me something..

                not that I want them to care since it'll eventually be found out during DROS I just don't see how the extra FDAS step on local transactions really matters..

                  Like mentioned the FDAS is no-charge. Once the DOJ gets their $300 yearly renewal fee they don't care if anything else makes sense.

                  DEPARTMENT OF JUSTICE FEE SCHEDULE: Secondhand Dealer/Pawnbroker Application, JUS 125 = $300 (New or renewal application, payable to DOJ)
                  Criminal Offender Record Information Background Check = $32 (Each applicant, payable to live scan agency.)

                  The DOJ fee schedule does not include any additional fee that the licensing authority may charge for processing this application, pursuant to the Business and Professions Code or Financial Code, or for the service of taking fingerprints for the criminal offender record information background check. Payment to the DOJ must be made by check, cashier's check or money order. NOTE: The fees are non-refundable. Cash will not be accepted for payment. Make remittance payable to "Department of Justice."

                  Should the applicant(s) be printed using the fingerprint hard card (FD 258) because the printing agency has an exemption to the Live Scan requirement, the fingerprint hard card(s), along with the required fees, payable to the DOJ, must be sent in with the application.

                    It is the government, it does not have to make sense.

                    It is not possible to get all the information if the person is not local.

                    If you buy the firearm for inventory, a DROS is not always submitted since you could sell it out of state, which means it should only apply if there is no DROS done, but you don't know that until it sells.

                        second hand dealer license

                        Hello people im a green ffl I just found out about the second hand license my local pd had very limited information so if I buy a used gun out of state or not local I.e gun show for inventory. I dont need the license but if someone comes to my store or I do consigned I need it
