    FFL01 and Out of State Purchases

    I've searched all over Calguns and Google without finding an answer to my question.

    Let's say I have an FFL01 license but I don't meet the requirements for transferring/selling firearms in California.

    Could I legally purchase a firearm out-of-state and bring it back to CA without breaking any laws?

    What do you mean you don't meet the requirements for transferring/selling firearms in California? Is your FFL01 for the state of California or from another state? That may help us better answer the question.

      I do not currently possess an FFL license of any kind. I was mostly wondering if I could obtain one to for purchasing firearms (mainly handguns) from stores in other states besides California while still being a CA resident.

      If I apply for an FFL01, but do not obtain centralized firearm dealer status or get a COE, would the license still be valid in other states?

        How would you sell those firearms? The ATF won't give you a license if you are not intending to be in the business of selling firearms or a gunsmith.

        The FFL is not intended to be used so you can buy guns for yourself.

        If, however, you were getting an FFL01 to be a gunsmith, then yes, that same FFL01 could be used to acquire handguns legally while out of state.

        Realize you won't get the hi-cap mag permit so you would still be restricted on magazine size and your "FFL" entity would own the pistols since you would never be able to DROS them to yourself.

        Seems like a lot of hassle for not much gain especially since you'd be paying retail for the firearm.

        You would still need the appropriate business permits from your city/county to obtain the FFL as well.

          Thanks for clearing things up. I knew it couldn't be that easy.

          I was thinking about getting in to doing local FFL transfers, so I will probably look into what is required for my area before I proceed any further.

            So far it's not really all that hard on the paperwork side. I'm doing mine from a rented building, which may prove to be more of a pain in the rear; with this, I have to get landlord permission etc.

            Just doing transfers for friends, bringing in guns for them etc. seems to be enough to justify "in business" (a term that really doesn't have a quantification).

              so if you have a 01 ffl you can buy firearms out of state and bring them home with you,but they are property of the business is this correct???

                Correct. I believe if purchased from a store you still need the CFLC Approval from them. Private parties you would not, but would need to document their address as part of the acquisition.

                    PPT outside of California is just a "private sale" and must be on roster.
                    PPT as used within California is face/face with buyer/seller at same FFL and does not have to be on roster.

                      This correct. I just drove up to Reno and picked up a CMMG AR10 style rifle and I just installed the bullet button before driving into CA. They DID have to generate the CFLC number to legally transfer to me in CA even though there was no actual shipping involved.

                            You would need to have your CFD number and the selling dealer can generate the CA required cflc number for the transfer. As long as the gun is CA legal configuration you should be fine
