    No longer elegible for firearms

    I have a client who has firearms, his son, who lives with him, also owns a gun but is no longer eligible. With the CADOJ now confiscating guns, because gun records are being cross referenced against mental and criminal records, how can he best protect not only his son's gun but his also? What can I recommend he do? Can he store the guns off the premises at his place of business or at a neighbors house or does he need to store them with an FFL? Thanks for any help or advice.

    This question seems to be coming up a lot lately.

    The best advice that I've seen offered the last dozen or so times this question has been asked is this:

    1) If your son is now prohibited. He may no longer possess any firearms that he may own. That means he should legally transfer them to a non-prohibited person. Go see the FFL.

    2) Your son may not "possess" firearms that you may own, or have in the home that you share. "Possession" infers that there is an ability to exert some amount of control over the firearm. There is no prohibition on having firearms in the home, the prohibition is on "Possession."

    3) The best way to ensure that your son does not "possess" any firearms located in you home is to store them within a gun safe that he does not have access to.
    If you build a man a fire, you'll keep him warm for the evening. If you set a man on fire, you'll keep him warm for the rest of his life.

            That's probably not going to work. Most prohibitions apply federally. Moving only works if the prohibition is under state law only.

                IANAL, and this is not legal advice.

                Unless the laws have changed, and the DOJ has not updated their website, his son (if a blood relative, not a step son/adopted) may transfer the firearms to his father via an familial transfer.

                If I am not correct, I'm sure someone will chime in soon. Possibly Librarian.

                Public Where do I find laws regarding the possession of firearms? I'm not sure whether I have a California record that would prevent me from owning/possessing a firearm. Is there a way to find out before I attempt to purchase one? What is the process for purchasing a firearm in California? How can I obtain a Carry Concealed Weapon (CCW) license? Can I give a firearm to my adult child? Can he/she give it back to me later? Can I give a firearm to my spouse or registered domestic partner? Can he/she give it back to me later?

                And since the son is prohibited, as stated in a post above, the guns must not be accessible to the son.
