    When is an item considered abandoned?

    I have a stripped lower receiver in my safe that's been there for several months. It's an out of state transfer that the customer has missed the 30 day mark twice. Missed 2 appointments to come and start the DROS the 3rd time. And that last time has been at least 2.5 months ago. At what point is something like this considered abandoned and what would be the proper procedure to deal with such a thing?

    They basically owe me more than the item was originally purchased for in rent or penalty fees (whatever you prefer to call it) at this point as I charge a penalty after the first 30 days and each consecutive 30 days after that.

    The item is a $50 blem lower.

      Call the customer and let them know that he/she has one week to come in and reDROS it. Then, if he/she doesn't do that or if it goes past the 30 days again, inform the customer that you will be charging a $10/day storage fee. That seems more than fair to the customer so, he/she can't beach about not knowing. You probably should come up with some policy (you can always waive it at your discretion) about this and post it at your location.

        Since you seem to have a policy regarding storage, you would also have a policy regarding abandon items, but at this point I would say that you can do what you want with it.

        Remember, they do not own the firearm until it is transferred. They could try to sue you in small claims court, then you counter with all the storage fees and you should get a nice judgement (which isn't worth much unless you know where they work or they own property, such as a house, vehicle, etc.).

            I think this would come under the storage/mechanics lein laws. You would have to post somewhere the item is abandoned and you can take bids or keep it.
