As an HSC Instructor I like doing them. It gives me a chance to see how others direct the demo. I have had only one case where someone didn't require it telling me there was no need as I was an instructor. I have never looked that up to see if it really is an exemption or not. I have never had another HSC Instructor that I had to have perform a demo either.

So, in a DOJ audit, if I don't have the affidavit for an instructor which PC do I cite? I couldn't find anything that said they were exempt. The guy didn't mind doing it but I am curious.

I've got two regular customers that are instructors. Neither one minds doing it but I feel silly asking them.

I'm not a lawyer or yours. You should consult counsel if it really concerns you.

But if you want quick reference, you can use this from the CA DOJ website:

When a DOJ Certified Instructor purchases/acquires a handgun, can he/she sign the Certified Instructor portion of the Safe Handling Demonstration Affidavit?

Instructor may oversee his/her own safe handling demonstration and sign the safe handling demonstration affidavit.

So in your words as "exempt" maybe not. But they can fill out their own affidavit.

Have them do it blind folded or behind their backs. Maybe in a paper sack, wait, you couldn't see it then. Remember, always in a safe direction!

Seriously though, it takes 10 seconds and then you can sign the form without feeling like you fudged.

Unless someone can point to a specific exemption.

Maybe call the DOJ? They are sometimes quite helpful.

Well, that would be a good way to mess with an auditors mind

Just had this happen today and they finally put "instructor exempt" on it. Never been asked to do a demo.

FFLs are not exempt from the HSC requirements and there is not HSC exemption for a HSC instructor, which means that all of the requirements apply. including the safety demo.

So unless someone can post something from the CA DOJ that says otherwise, it is best to treat an instructor just like anyone else, although you could have them do the safety demo themselves and have them sign it :-).

The manual also says to add "CI" to the front of the HSC number for the DROS.

I have signed my own affidavit. I have been inspected and it was fine. The DOJ inspector jokingly asked if I talked to myself during the inspection.
