    AW Possession

    It wasn't me! Promise....

    I don't want to name shops on here but I spoke with somebody who is affiliated with another FFL and they had a DOJ audit and was found in possession of a few (1-4) guns that were either banned by name in CA, or features. I know at least one was banned by name. What would be the best course of action for this dealer? I've already given them the name of a firearms attorney in that area. What would be the penalties that could come down on this shop? Ive heard of places being shut down, firearms seized, licenses revoked, jail time? Does anybody know what this person could be up against?

    I want to help point this shop in the right direction, I'm not trying to pour salt in somebody's wound here.

    Well let's see shop commits 1-4 firearm related felonies = FFL pulled, LOT's of $$ on Legal team trying to stay out of prison.

      If it were me I would first "EDIT POST" and then "GO ADVANCED" and then change the spelling of possession in the subject line.

        Since there are no names mentioned, as well as very limited details, it is not really a big issue with it being posted in my opinion.

        My opinion is only an attorney who deals with firearms issues can really give an answer. You might also suggest that they look to see if there are any lawsuits dealing with the so-called a-salt weapons as they might have additional insight, as well as perhaps being able to be added to the lawsuit. The major attorneys dealing with firearms should be consulted, even if they are not the primary attorney. CalGuns Foundation, NRA, etc. all might be able to help. The key is not to wait to see what happens as then it can be too late.

        I suspect all of the above could be what they could be subjected to. It is a reminder that FFLs need to be careful.

        Also, it is important to realize that the ban by name only applies to semi-auto firearms, so a lower would not actually be banned. They could be threatened when it does not really qualify.
