    Interstate, Incoming Rifle

    I have a Texas resident sending a 30-06 rifle to me for a transfer to a local resident here in Ca. He did not send it through an FFL in Texas, sent it direct. I have read through the DOJ DROS book and can't find a clear answer. Is this an "Acquisition" in DROS, as the seller is not in state? He sent the gun with a Bill of Sale and a copy of his Texas DL? Is this legal or do I have to send it back?

    He can send it direct to your CA FFL. It must go through an FFL because it is an interstate sale. I do not know how to fix the situation that you are in now. Contact a trusted California FFL dealer?

      the OP is an FFL.

      he's asking how to properly log the firearm into HIS books. he isn't a private party that received a direct shipment.

        Correct. I am a new FFL, never had a direct send from a seller. The DROS book is a nightmare to read. I assumed this is an "Acquisition" in the DROS entry system, that was the question? If this is OK to send direct.

          You just log it in just like any other firearm which is being shipped to you, but in this case you use the person's name and address, since they don't have a FFL. It is helpful, but not required, to have a copy of their ID so you can make sure that you have the correct information, which the seller was nice enough to send you.

          The DES acquire is for when you are buying a firearm from a CA resident for inventory, it is not for transfers.

          Or perhaps I should say it is not legal and you have to send it to me :-).

            Thanks. Incoming in bound book with his (sellers) info, then a DROS for the buyer on the standard long gun dealer sale. Thanks again.
