    Power of Attorney to PPT handguns??


    So here's my question:
    I have a customer who wants to sell some unwanted used handguns.

    [B]My I as an FFL dealer sell these for him as a PPT with his Power of Attorney?

    I know all his personal information. The POA would be for the signatures.

    No, I don't have a "secondhand Lic./permit".
    No, he won't be available to do the paperwork himself.

    So, now it is ironic that the State whittles away at the right of its citizens to defend themselves from the possible oppression of their State.

      There is a CA DOJ POA form for allowing someone who is prohibited to have another person sell their firearms, so I would say it is possible.

      Since you are a FFL, I would say that it is questionable since it seems to be a way around being a secondhand dealer.

      You can do a PPT by having the seller come in and fill out a DROS worksheet, then later have the buyer come into finish the DROS and submit it, so you would not need a POA to have him sign the DROS worksheet.

        Thanks for the DOJ info!! I checked out the POA on the DOJ web site. As it stands, my customer does not fall within any of the categories noted.
        He is terminally ill with no relatives and in need of $$ for hospital bills.
        Since I do so little sales in "used" firearms I have not made the exorbitant expenditure for a second hand license in my county. And we all know that that license in nothing more that revenue maker for local governments.
        I like to help him out but I'm hitting walls...
        Maybe I can try posting then on the "For Sale" thread...

          My point on the POA is that it seems to be allowed, yes it is normally for people who become prohibited, but if a POA was not allowed for CA transactions, then the form would not exist.

          I would think that posting ads would work. He could sign the DROS worksheet to make it easier for you to transfer. Or another person could do a POA so that you are not doing both.
