    Question for a FFL

    My daughters are looking to buy a gift for me. (.45 1911). I am having difficulty finding a reasonably priced one that could be shipped to Calif.

    I understand that there is some exemption for intra-family (immediate family) exchanges like gifts. I guess my question is this: If they were to buy one that is not on the California list, can I bring it back home (locked container, checked baggage)? I should mention that one lives in Colorado, the other in Washington.

    If the answer to that is yes, what, if any, paperwork needs to be completed, by them, by me etc.?

    What would the process be?

    They would need to have it shipped to a CA FFL that is familiar with interstate intrafamiliar transfers and that they are roster exempt. Camarillo is near San Diego right? I recall a thread I participated in a few weeks ago where several FFL's in that area were recommended. I'll see if I can locate it.

      Thanks Tony. Camarillo is about 40 miles north of LA on US 101. (on the way to Ventura).

      If I understand, the fact that it is interfamilial makes it roster exempt?

        Oops, wrong Socal. Yes, because it is intrafamiliar, it is roster exempt.

          Because they are in another state it needs to go through an FFL.

          They should also include a letter from them stating the make, model and serial and that they are gifting it to you.

          This will fall under a transfer so ask your FFL for their transfer fee.

          You will need to pay DROS

          You will need to wait 10 days

          You do not get to keep the high capacity magazines

          You are not exempt from 1 in 30 rule
          Just a normal guy

            There are several FFLs in the area which can do the transfer, including myself. Fort Courage Armory and I believe EBR both know how to do it.

              Because parties involved are residents of different States, Federal laws [18 USC 922(a)(3)&(5)] require the firearm to be transferred through a CA FFL dealer. Failing to use a CA FFL dealer equates to Federal felonies for all parties (person giving & person receiving) involved. There is no intra-familial gift exemption to the Federal laws.

                Acquisition of a handgun by a non licensee in a different state would be a violation of federal law.

                  Your daughters can buy you a gift of a non-roster handgun and it can be shipped to CA and transferred as an exempt intrafamilial transfer. Make sure that the FFL knows how to do it and is willing to do it.

                  As said, your picking it up out of state is illegal.
