    interstate private party transfer

    I have a customer inquiring about a private party transfer of a used, non-listed handgun. I'm thinking this is ok - so long as it comes to me from another FFL, and complies with the CFLC but I've never done one like this. Any guidance on this?

    There is no such thing as a PPT where either party is a resident of a different state.

    That said, if you have an FFL, why do you think an OOS firearm would need to be shipped to you from another FFL? Anyone can ship a firearm to a FFL unless the FFL has a policy against it.

      If it's an off-roster handgun (off list?), the California FFL it goes to has to be able to perform a SSE (single shot exemption) conversion on it. You can covert it back from SSE once you take possession of it, but it's an additional cost.

      There IS no such thing as a PPT transaction for residents of different states, as noted.

        Need a little clarification on this.

        Are you doing an interstate transfer or a PPT? It sounds as if you are doing an interstate transfer. If you are an FFL there is no requirement it comes to you from another dealer. If it comes from an individual you would not have a CFLC with that nor is it required. Off roster handguns can not be transferred unless the purchaser is roster exempt. Unless you are doing an SSE conversion for the buyer then you wouldnt be able to transfer a non roster pistol to a non exempt purchaser.

            Yea, the transaction must be completed through a FFL in the buyer's state of residence. California requires that all handgun transfers go through a FFL too. Why do you think Ca says no?

              The issue more lies with the fact that CA won't allow a PPT between a resident and non resident and considers it to be a dealer sale and thus subject to roster restrictions. So hypothetically if Buyer who lives in CA and Seller who lives out of state were to both come to a CA FFL and try to do a PPT it still cant be done as a PPT because CA requires BOTH buyer and seller be residents of CA.

              However seller can ship gun into state and have an FFL do the paperwork, but then that gun is still subject to the roster where normal PPT's are roster exempt.

                  Can still obviously use FFL who is equipped to perform SSE conversions (additional cost). Or, the sellers who are multi-state residents (who are like GOLD).

                    A CA PPT is where both the buyer and the seller go to the FFL. Both have to be CA residents with CA ID/FL or military ID with duty orders. This is exempt from the certified list and the 1 in 30. Most assume that if you say PPT, that you mean a CA PPT.

                    You could call a transfer from a private party where the firearm is shipped a PPT, but then it gets confusing and most will not understand what you are actually talking about. It is really just a transfer as it does not matter if the firearm is coming from a private party or a FFL.
