Can a FFL Store a gun for a Person?

    Can a FFL Store a gun for a Person?

    I'm moving to california soon, and I will be traveling for my job quite a bit months a a time, I will be renting a place and I dont feel comfortable keeping my guns there while i am out of town,(im single) and i wont be able to install a safe.

    can an FFL hold on to the guns for me while i am gone and then i retrieve them when i am back with out having to do paperwork on each gun?

    ill gladly pay for the storage and write up a contract. but I would prefer dealing with an FFL that is active member here and is willing to do it. also ill be moving to the palmdale/victorville area.

    If a customer brought in a few firearms for cleaning and told me he couldn't pick them up for a month, I'd have no problem with that. Repair/smith returns wouldn't require a DROS. Storage fees would apply though.

      Don't you still have to log them in/out of the bound book when they are held more than 24hours? I have had a similar request and was unclear on the ATF rule.

        My storage would be more like 2-3 months at a time.

          Most FFL's run different A&D books for gunsmithing versus the sale/transfer book. So yes, the gun is logged in, just the book it's in indicates (to us anyway) that the background check isn't needed when the owner comes in to retrieve the repaired firearm.

          Most IOI's wouldn't bat an eye at seeing guns in for repair for 2-3 months at a time. Sometimes it can take that long just for certain backordered parts to show up.

                  The question I would want to know is what happens when the person never picks up their guns? Not that the OP on here would do it but at what point do you say ok, its been 6 months and we've called, wrote and cant get in touch with so-and-so, what happens to the guns at that point.

                  Im used to being a storage unit for people, but everything here has a 4 month term where they pick it up or extend their loan for 4 months. We have guns that have been here for a long time but still are on loan.

                  I guess what I'm asking is if you agree to 'clean' somebodys gun and a year goes by then what do you do?

                      When the shop I worked at closed, we had several guns in for repair which had been there for over 12 years. People either moved and forgot about them, died, or ????

                        Yeah. I'm going to have to write something up to cover contingencies and multiple forms of contact and alternate contact. And what to do if I cannot be contacted after a certain amount of time.

                          Don't try to make things your problem. Why do you need multiple forms of contact and alternate contact? It is not your problem to contact the person. One means of contact means that either you can contact the person or not. If the person changes that contact, it is their problem to update you on their means of contact. If you think it is really your problem, then you can spend a lot of time and effort dealing with it and who is going to pay you for your time and effort to do that (especially if you don't have a policy to deal with it)?

                          If you receive or store a firearm, then the customer needs to do what is required within a timely period of time. To deal with the issue on your side, you charge storage (a high amount), late fees (a high amount) and after a fairly short period of time you consider the firearm to be abandon (which is you can use the storage fees and late fees to cover the value of the firearm). The point to this is not to screw the customer, but to have enough penalties so that the customer decides to not go that route.

                          If you don't charge for storage or anything, then why wouldn't a customer take advantage or it? Free storage is something that could work for them.

                            im actually the customer in this case, i was just trying to find out if it is legal in CA for a FFL to store a firearm, so actually it is my problm to write up multiple ways to contact me (phone, email) and alternate contacts and i do intend on pay the FFL for storage probably to the tune of 10$/gun per month. 2-3 month intervals multiple times a year. and i would have contingency for if i dont come back from a business trip. and who to contact and who they can ship to.

                              Kemesa was more answering the secondary question posted by other FFLs here that were similar in discussion and our questions arose from us thinking about your original post.

                              But yes as a business owner I can tell you nothing is more frustrating that when a customer comes in all pissed off because we never contacted them and then find out later they moved or changed phone numbers and never told us.

                              So yes, in my opinion it is the customers responsibility to provide us with all the means of contacting them. I can tell you Ive dealt with customers via, phone, email, text, and even lots of PM's here on calguns.

                              As far as contracts go that is for the FFL's to use to CYA when problems arise. Like people leaving guns here for indefinite periods of time. I have a gun that has been sitting here for almost a year now waiting for somebody to come in and start their DROS. And had I had a written agreement with whoever sent this to us we would have dealt with it a long time ago. We do have a customer agreement, but we have them sign it when they come in. In this case we are SOL.
