On the new DES does Acquisition replace form 4334?

    On the new DES does Acquisition replace form 4334?

    Are you suppose to do this for long guns now also or still just handguns like 4334?

    I called the DOJ and it is my understanding that you are to do this for every gun you receive to transfer that comes from an individual and is not a PPT.

    Also if a firearm is mailed to you do you just not get their fingerprint/initials/signature?

    uhh... what is form 4334? I receive hand guns and long guns from private parties a lot shipped to me. I don't log them in any differently than dealer shipments other than the FSA.

    For consignments or something I buy and sell used I am now usign the Acquisition system instead of FDAS....which reminds me I need to renew my 2nd hand dealer stuff...

      If you acquired a handgun prior to January 1st 2014 for resell you were supposed to fill out and mail in form 4334. At least that is how it was explained to me.

        Michael from the DOJ called me back this morning to follow-up about my questions. He said he spoke to others in the department and that all firearms, pistol and long guns, received from an individual, even those that are being transferred, are to be entered into the Acquisition section of the DES system.

        I asked him if it puts a 30 day hold on the item and he said no if entered correctly. Does anyone have any other option when they input it? When I select Acquisition I don't have an option to enter anything, it automatically selects Buy .

        This is all I see


        Michael gave me another number to call and I left them a message so I'll update this thread when I hear back.

        I also asked how wee are supposed to get a signature and fingerprint from someone who mails us a firearm and he said as long as we have a copy of their drivers license that is proof enough.

          This has already been answered by DOJ for us as a pawn shop. We are required to do the FDAS when we do a loan or a buy. However, when somebody mails it to you do not use the FDAS, just keep a copy of their ID along with your FFLs you keep on file and log it into your book like normal.

            .......No 30 day hold when somebody mails you a firearm. 30 day holds are for when you have a 2nd hand dealer license and you are buying from the customer in your shop. Then you would have to do the FDAS and wait the 30 days.

              That was my impression but when I spoke with Michael from compliance he told me ALL firearms received from an individual, even those for transfer, needed to be entered on Acquisition.

              I explained the scenario of Joe Public from San Francisco sells an on roster pistol to John Doe in our area and mails it to us with a copy of his ID and we enter it into our book and have John Doe fill out a form 4473 and we start the DROS. Are we required to enter it into the Acquisition area even if we are just transferring it and he said yes. I told him I thought this would out a 30 day hold on the firearm and he said no, not if entered correctly.

              I left a message for a field agent to give me a call so we'll see what they say. If anyone has a number for an agent that is helpful I'd appreciate it if you could send it to me via PM.

                I do not see in the Acquisition area where you can differentiate. The only option is BUY which isn't true because we are not buying, we are transferring.

                I am assuming he is confused and a field agent will explain it correctly. I do not see why we need to enter an Acquisition into the system when all we are doing is transferring.

                  Correct, you are not 'buying' or 'pawning' and that is what the FDAS is for. You are just doing a normal dealer sale.

                    He is mistaken. It would be like would you use the FDAS for a PPT? NO, then why would you use it for a dealer sale? The FDAS used to be a separate website that only 2nd dealers and pawnbrokers used. Now its integrated with the new DES and causing some confusion with dealers and apparently the DOJ.

                    I think that the agent you asked must not have understood exactly what you are asking. Im sure you will get clarification on this from his supervisor.

                            That's pretty cool then. I'll give him the thumbs up for that. I've dealt with Ryan at the DOJ before when I had a question back when regarding a flash hider and she was super cool and took the time to explain to me why she answered my question they way she did, then listened to my rebuttal and my quote of the PC and how I felt she was incorrect in her original statement, then she asked her supervisor about my question called me back and said that I was right and her first answer wasn't correct.
