    Husband/wife transfer question

    Hey CG FFL's,

    So here goes, my wife bought a Kahr 9mm because she knew I wanted something smaller for CCW and presented it to me on Christmas. (She did the paperwork, waiting period, got her HSC, etc) That being said, I just got off the phone with my Sheriff's Dept and was told that the gun needs to be registered in my name before I can add it to my CCW.

    Here is my question: I have been doing some research and I am pretty sure I can do the "Operation of Law" DOJ form but I have a question about that:

    Does anyone know what the turn around time for that is? How do I know when the transfer has actually been completed? I am looking to add this firearm to my CCW asap but I want to make sure that the gun is actually in my name when they run the serial # to avoid problems and to make sure I dont waste anyones time.

    Also, is it even possible to do a PPT and if so, is it faster?

    CA DOJ will mail back acknowledgement anywhere between 2-30 weeks.

    However...
    When CA DOJ cashes the check, is a good indicator when they inputted the info into AFS.

      Thank you for that.

      Now, do you know if it is even possible to elect to do a PPT?

      I would rather not wait up to 30 weeks to add this firearm to my CCW!

        Yes, you and your wife can PPT (4473/DROS/10 day wait) it.

        However...
        It's less expensive to just mail in the form and, legally, ownership changes hands the moment you mail off the form.
        When they update AFS to reflect the change of ownership is another matter.

          I think the change with AFS is my concern. According to my Sheiffs dept I need to have the gun in my name before it can be added onto my CCW so if I sent in the form, I believe I would need to wait until AFS was updated in order to add it to my permit?

          Also, if we do the PPT, is the gun "officially" in my name after the 10 days? (Which should allow me to handle my CCW business)

              A PPT would be faster since the change would occur within 10 days. Sending in the form is much cheaper and also means that the firearm does not have to be held for 10 or more days.

              You might ask your Sheriff how you deal with a firearm that a husband/wife share. There is no law that the firearm has to be in your name, but some department have their own rules.

                I appreciate that answer. So it is truly anyones guess as to when the transfer actually takes place with the form is sent in? If that is the case, I may be inclined to do the PPT so I can just get it over and done with so I can add the gun to my CCW.

                Also, I will contact my Sheriff again and ask them what to do if we share the firearm.

                  The problem with sending in the form is that while they might quickly process it, they might not inform you about it. I suspect that the information would be quickly processed as they want to know who owns the firearm.

                  Personally, I would just send in the form and provide a copy for the Sheriff (or ask them about that as well).
