    1920 Remington Model 12

    Hey all,

    My grandfather is gifting me his old model 12. My folks back in Indiana are taking care of the shipping with the help of an FFL there. The FFL told them that the rifle would not be california compliant because it can hold more than 10 rounds (I presume because it can hold more than 10 rounds of .22 short?) Is there any validity to this information?

    I question it because this is the same FFL that told them since I hold an 03 FFL that it was totally ok to just ship me a C&R pistol that he's also gifting me.

    Well I got my question answered. I wasn't searching for "tube magazines" in my original Googling. I'd delete the thread but it looks like that vBulletin feature is disabled.

      No, validity.
      .22 caliber tubular magazine = exempt from CA's large capacity magazine laws. [PC 16740(b)]

      Find a different CA FFL dealer.



      Penal Code 16740
      As used in this part, "large-capacity magazine" means any ammunition feeding device with the capacity to accept more than 10 rounds, but shall not be construed to include any of the following:
      (a) A feeding device that has been permanently altered so that it cannot accommodate more than 10 rounds.
      (b) A .22 caliber tube ammunition feeding device.
      (c) A tubular magazine that is contained in a lever-action firearm.

        If you are an 03FFL then it's perfectly legal for your parent or grandparent to ship you a C&R pistol. Transfers from parents/grandparents to their child/grandchild are exempt from California's dealer transfer requirements.
