Former LEO un roster handgun back to manufacture for warranty manufacture shipping new serial number gun can he still get un roster weapon back

Called DOJ last week and they said "no" because the model is not approved for sale. In this situation the owner is not exempt from the roster anymore since he is former LE it sounds? I was told that if the firearm is not currently on the roster the owner would have to work something else out with the manufacturer because he cannot receive a non-rostered firearm. I did not like the answer but that was the answer I was given.

It could be done as a SSE. I thought that there was an exemption when it was being returned for repair, but I can't find it in the CA PC.
It does not make any sense and it sounds like a call the to CalGuns Foundation might be in order.
