    FDAS System Requirement??

    Just finished a CA DOJ audit and we had no problems except that we are not enrolled in FDAS for consignments and do not have a second hand dealers license. Our city not only does not require a "second hand dealers license" no such license exists locally, nor does the local PD take any reports on firearms taken in on consignment, trade etc. nor (according to them) do they have any infrastructure for doing so.

    SO how am I supposed to get a second hand dealers license when my city doesn't issue them?

    Secondly, I was under the impression that you were only required to enroll in the system if your locality required said license.

    The paperwork I was given is from DOJ was really unclear about the requirements and does not state in black in white that we MUST enroll in the system whether or not our locality requires a second hand dealers license.

    Any body have anything concrete on this?

    If I remember correctly, you need to get a letter from your city saying that it does not require nor issue a secondhand dealer permit.

    It does not say on their webpage:



    If what is says is true, if they don't issue a license, then you can't be a secondhand dealer.

    I think that CA law requires you to enroll regardless of your local requirements.

      But here is the catch-22, in order to enroll I MUST have a valid secondhand dealers license...which I obviously cannot get!
      It even says so on the paperwork CA DOJ gave me, I've been doing business without this non-sense for years and this is the FIRST time it has ever come up.

      The letter they gave me says I must posses a valid second dealer license issued by their local Chief of Police or Sheriff...my local police issues no such license...so I guess I can't enroll...

      This seems such an unnecessary waste of my time...

            I'm curious what the inspector said about the lack of a Second Hand Dealer License. Was there any penalty or ramification, or did they just say to get compliant asap?

              According to them its EXTREMELY common for them, the majority of dealers in this situation have no idea. I have 6 months to get compliant, no ramifications otherwise.

                Thanks, that's good to know they are not coming down hard on you. I had no idea either until a month ago, and our PD had no clue either. I suspect more FFL's are not compliant than are. Please keep us posted if/how you ever get your local LEA to issue a license.

                  This is the second CA DOJ audit I've been through and they've always been pretty easy to deal with and they get done superfast.

                  ATF is inconsistent, I've had audits take four days and others take three weeks because they drag their feet. Either way, I've never had any bad experiences. I figure if you're accommodating everything usually goes real easy.

                  It seems that if they know you're making the effort to be 100% compliant, you won't have any problems even if there are the odd mistakes.
