    ANOTHER C&R transfer question...

    Hey,

    So sold a C&R long gun on Gunbroker to a guy in MA. I'm an 01 FFL. He wants to just give me a signed copy of his license and have me ship it to him. Sounds ok to me, but how do I find out if this is legal to do in MA? Should I call the ATF? Doesn't sound like they would know because it's MA law I'm worried about.

    Any ideas?

    Crossing state lines it obviously needs to go through a FFL in the buyer's state of residency. That is FEDERAL LAW and any 01FFL should be aware of that. Of course, most aren't.

    Edit: Ooops, If he has an 03FFL, it would be legal since, you would be shipping to another FFL holder. That is, as long as his state doesn't have any laws restricting it.

      ...hence my question. How do I find out if it's legal in MA to send to an 03FFL?

        Ok, I'll answer my own question based on the research I did, just in case someone looks up this thread.

        This is a quote from an MA forum, but seems to sum up best what I found:
        Mass FFL's, C&R or not, can buy or take delivery of, any firearm they're licensed to do business in/with - and can also transfer/sell them.

        The caveat is that they may only sell/transfer to Mass residents firearms that are on the Mass Approved Roster.
        All firearms not on the Mass roster can be sold transferred only to non-Mass residents/FFL's.

        That is the reason many Mass FFL's won't deal in non-roster firearms - they have no ready market for such, unless they regularly deal online or at non-Mass gun shows.

        You should be legally able to receive any firearm that's C&R listed - you just may not transfer/sell some/any to another Mass resident unless they have an FFL.
        Most of the restrictions are handgun related as well. Folks, for once, BE GLAD you are in California rather than Massachusetts. Did you know it's illegal to have/display a spent casing in MA? What??? Insanity.
