    ATF declared no more private party shipment into CA

    So I have a customer who purchased something from a private party outside of CA. I send my customary info (not full FFL), but the person said they called ATF and were told they are expected to have a full signed copy of my FFL. I don't agree with that so I just called the ATF (925-557-2830 : dublin branch) and the agent that answered the phone said basically:
    1) CA FFLs are no longer allowed to accept private party shipments
    2) It wasn't Federal law but CA law that caused the restriction

    I am now trying to find the CA law that says all shipments outside of CA have to go through an FFL. Has anyone heard of this? I have a feeling the ATF guy that answered didn't know the CFLC is only for dealers, but not sure if I'm missing something now.

    California Firearms Licensee Check (CFLC) Program Are there any costs or fees to obtain a Firearms Shipment Approval number from the Department of Jusice (DOJ)? I am not a Federal Firearms Licensee (FFL) but I want to ship a firearm from another state to an FFL in California. Do I need to obtain a Firearm Verification Number before shipping a firearm to California? I am an FFL in California. How does the CFLC program affect me? Are any California FFLs exempt from the CFLC verification approval requirement? I am an FFL located outside of California.


    I think they are confused... the FaQ #2 says non ffl can ship , unless of course Kamela is up to some funny business.

    No. Only shipments from Federal Firearms Licensees (FFL) require a Firearms Shipment Approval number.

      As one of our lawyer members recently posted, BATF staff are not a good source for CA law information, and CA-DOJ staff are not a good source for Federal law information.

        I get this, but when they tell out of state private parties that they require a copy of my FFL that's a federal thing and I'm not sure why they are saying that. Now the private party shipper is saying that he is required to have my signed/dated FFL because the ATF confirmed that with him. I don't think it's reasonable for me to tell him to keep calling until he gets an agent that says something differently. I even provided him the FFL Newsletter with the reference of this not being required, but his phone call sealed the deal that he is in the "right".

          If the newsletter is not good enough, tell him to ship it through a FFL or to find another FFL to do the transfer.

          The idiots at gunbroker say that a copy of the FFL is required and they refuse to remove that unless they get a letter from an attorney at the BATF. The newsletter and the Federal Code is not good enough for them either.
