    Transferring lower receiver

    My brother just bought an AR parts kit and completed it with some help from a cousin of mine who is a veteran. I want to do the same but instead of purchasing the whole kit just start off with a stripped lower and start from there. The problem is I didn't know in order to purchase the receiver I had to be 21. That blew my mind! I'm only 18. I'm trying to expand my knowledge in this amazing gun community. And I thought for my second rifle I could start off with this AR. Is there anyway I can obtain the receiver legally? For example is it possible for my brother to purchase a lower then pass it down to me? Or transfer gun ownership?

    Nobody can purchase a firearm for you in order for you to circumvent a law. It is not legal for someone under the age of 21 to purchase a lower. It would be legal for a person up or done he familiar ladder to gift you one, but if they are buying it with the intent of you getting arou d the law they would be breaking it.

      Yeah that makes sense thanks Ocarmory. I just don't understand if it's a part of a rifle why can't someone who can legally own a rifle purchase it.

        thats because it is not yet a rifle, and the exemption for 18-20 year olds only applies to rifles and shotguns.

          What would you guys go about doing if you were in my position and wanted to build an AR?

            I'd buy an AR Eddie. Simply put federal law prohibits the sale of firearms to persons under 21, the exception being rifles and shotguns. A receiver is neither so you have to be 21 to purchase. I would buy yourself a factory built AR-15 after its all said and done what's the difference between building one and buying one? If you don't like particular parts that your factory gun comes with you can always swap them out.

              Maybe buy a base model AR like a M&P15 Sport and replace the parts you don't like.

                This is would not be lawful for your brother to "pass down" a firearm to you.

                  If I had a parent or grandparent who was a California resident I would tell them I wanted a stripped AR lower for Christmas. It's legal for your parent or grandparent to give you one as a gift if both parties are California residents. It really has to be a gift though. They have to pay for it and you can't give them any money for it.

                  If they don't want you to have a firearm or if they aren't in the habit of spending $150 on gifts for you then this method won't work.

                    That can actually work my dad and my brother can halves on the receiver and give it to me for my birthday present. Is this really legal???

                        Legal? Yes, but the question should be at what point does this border on a straw purchase because the brother is involved?

                          It shall be unlawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver - (1) any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe is less than eighteen years of age, and, if the firearm, or ammunition is other than a shotgun or rifle, or ammunition for a shotgun or rifle, to any individual who the licensee knows or has reasonable cause to believe is less than twenty-one years of age

                          Now, there is nothing illegal with the ownership of the firearm. Underage individuals can own firearms without purchasing them. The issue would be with a dealer transferring it to you, the under 21 year old.



                          27875 (was 12078(c)(2)) also means parents or grandparents can transfer handguns to children or grandchildren 18 or older. Since it's illegal for dealers to transfer handguns to people under 21, this is the way people 18, 19 and 20 can legally receive handguns. (Penal Code 25605 (was 12026) is quite clear that those 18 and over can "own, possess, [and] keep ..." a pistol or revolver.)

                          The way I interpret this would apply to a receiver also.
