4473 and birthday

So I'm turning 21 in October, and planning on picking up a handgun. I'd like to pick up day of, but the store I was at said I wouldn't be able to, that I would only be able to fill out the 4473 day of or after I turn 21. However, I was told somewhere else that I can go in ten days before my birthday to do the paperwork. Which store is right?

ATF would consider your filing out the 4473 to be a sale from how I am reading it. Plus you probably will get a DOJ denial also.

What the US Code is saying is the legal age to purchase a firearm is 21. They provide an exception for Shotguns and rifles.

So the way I read it is if you were to fill out the 4473 10 days before you turn 21 that dealer would have violated USC by selling you the firearm before you turned 21, they would have complied with the USC when they delivered it once you turned 21. But the violation would be when they sold it to you. Somebody correct me if I am interpreting this incorrectly.

You will need also at least two proofs of residency.
I'm not sure how many young people buy handguns these days as they usually want a bill from a utility in your name or a lease on a piece of property as ID.

Are you saying CA ID plus at least two proofs of residency Nasty? All that is required by DOJ is CA ID and any of the following:

Utility bill reflecting services to a fixed place of residence. The utility bill must bear on its face both of the following:
The name of the transferee.
Either the residential address declared on the DROS form or the address as it appears on the transferee's identification.

Residential lease that bears both of the following:
The name of the transferee.
Either the residential address declared by the transferee on the DROS form, or the address as it appears on the transferee's CDL or CID.

Property deed the bears both of the following:
The name of the transferee
Either the residential address declared by the transferee on the DROS form, or the address as it appears on the transferee's CDL or CID.

Government-issued (city, county, special district, state or federal) documentation that has all of the following - - This does not include a drivers license or DMV-issued ID card:
The name of the transferee as it appears on the transferee's CDL or CID.
The name of the transferee as the transferee declares on the DROS form.
The residential address of the transferee as it appears on the transferee's CDL or CID or the address update attachment to the driver's license/identification card.

Examples of acceptable proof of residency pursuant to newly-proposed regulations:

Bingo! You will need either an HSC Card or exemption also. But that is a different requirement.

HSC is 30 question test on handgun safety. Your LGS can sell you a study guide for $.50. Its pretty basic, 10 T&F 20 Multiple choice questions. Cost is $25 for test and issuance. You'll need the HSC card to start the DROS on a handgun.

There are exemptions to this requirement though, I don't know your situation, see if you fall under this category first before you pony up the money for the card. You can google it to see what all the exemptions are.

Nope, none of those are me. I think I already have a guide lying around the house somewhere, but when my dad did the test when he got his XD a couple years ago, he said it was pretty much all common sense.

Yes, it is. Just be sure to read all the answers before you select one. Sometimes all 3 answers are right and the 4th says all of the above! I see people always miss those questions!

I believe that you "buy" the gun when you fill out the DROS and have it submitted. The 10 day wait is just for the state nannies to withhold access to your property.

If they submit DROS before you are 21, you will be denied. Dealer Record of Sale. It starts the day you start the DROS, not the day delivered.

There is noting stopping you from going to knowledable store and picking out and paying for your gun now and they wait to start your DROS until you are old enough.

Doesnt need to be notarized.
When I purchased my 1911 at turners I tried to use a one day expired vehicle registration (new one was in the mail) and it was denied, so the clerk gave me the rental agreement form. I filled it out, had my father sign it and turned it in, 10 days later I walked out with a 1911!
