    Logging CMP rifles in C&R book after 1/1/14 ???

    Odd thought just came to me.

    Currently if you use your FFL03 to purchase a C&R pistol/rifle you have to record the appropriate information in your book. If you don't use it then you don't have to record a purchase. (ie: new guns, or old ones if you didn't use your license during the transaction)

    I'm a CMP customer and have purchased a few Garands from them in the past. No need to record the purchased in my book because I didn't use my FFL03 to facilitate the purchase right?

    Okay, now comes 1/1/14 which requires one to have a FFL03 and COE to continue to purchase (and have delivered to your door) C&R rifles from CMP; so in order for CMP to be compliant with the new California law they'd have to have your current FFL03 and COE on file to ensure (to themselves) that you met the requirements of the new law. Then sale and ship as usual.

    Doesn't that constitute using your FFL03 to facilitate the purchase, therefore requiring you to now record those purchases in your log book?

    Just askin.....

    Oh, BTW I haven't seen a definitive answer from the CMP on how they plan to handle California customers (with the requisite paperwork) after 1/1/14, but I've sent them my paperwork to have on file in case they decided to continue sales to those Kali residents who meet the requirements of the new law.

    As a C&R FFL you are required to log in your bound book all C&R firearms that you acquire or dispose of while you are licensed. It doesn't matter if you "use" your FFL to acquire them.

    If you buy a Garand at your local gun shop and the dealer refuses to recognize your C&R FFL and COE because he doesn't understand the law and he makes you complete the transaction as if you didn't have a C&R FFL...you still need to log it in your bound book.

      nothing changes on 1-1-14 as it applies to the federal requirements that you "are" licensed and must log all C&R transactions that occur while you are licensed, whether you "used" your license or not.
