    Replacing a defective lower for a customer

    Hi guys,

    I had a customer buy a Spike's Lower through the Internet and I did the transfer (as a long gun). Turns out it's defective and the seller is going to deal with returning it to Spike's and wants to send my customer a replacement. What's the proper procedure for me to follow with the DOJ and on the 4473 (where the actual original serial number was listed)?

    Any help would be appreciated,

    Wow. No replies? That's odd. So the doj got back to me today. If the long gun is replaced he must re-dros it even though they don't have any record of the serial number. Sounds stupid to me but he said that's the way the law reads.

    Haven't called the ATF yet. I guess I'll keep posting in my own thread in case someone looks it up someday for info.

      If he ships it back and they make him one with the same serial number. They can ship it right to him.

        Havent been on CG in a week. Yes, you have to treat this new gun as exactly that. A new gun. New 4473, new dros, new waiting period.

        ATF will want you to show the gun in your book coming from spikes and being disposed to him. Now if you send it back to spikes for him you should Log it again in your book and dispose of it back to spikes.

        Im assuming based on your OG post that you dros'd this receiver and this guy completed the 4473. You have a completed 4473 right?

            Thanks guys. Sorry it took me a bit to get back to post. Confirming what you guys said, the DOJ called me back and told me that it all had to be re-run. Stupid really, considering the DOJ doesn't have the serial number nor even a record of what "long gun" it is. I understand the ATF wanting a re-run. Oh well, I told my customer no charge other than the $25 DROS.

              I would have been tempted to charge him. Make him remember why he should have bought it from you.

                You should make sure that your customer knows that you could have charged a normal transfer fee because he did not buy it from you. You are being nice at not charging him anything for your time and effort.

                I suspect that you are doing it for customer service, but if the person does not realize this, they can come to expect it from you, as well as others.
