    Active Duty getting an FFL in CA

    It doesn't seem like there are many people that have asked about this and I hate starting new threads but oh well.

    I saw the sticky about getting an FFL in CA with the business license requirement and I understand all of that. My question is about the military side to it. I called the local ATF office and they said that I would need to get signed approval from the Base Commander in order to get approval. I was wondering if anyone has heard of that actually being approved or if its just another set of paperwork that will forever sit at the bottom of a pile on someone's desk.

    In the event that it generally does get approved and either you or someone you know relatively well went through the process, what exactly did you send in your authorization package?

      You need base commanders approval if you open your gun shop on base. If you open your gun shop in the community you need to notify Chief of Police / Sheriff (Head LE) of that community.

        Alright, I understand that part. I'm curious if, in practice, this kills it for active duty. I know that is the case with importing assault weapons as active duty the base commander approval requirement killed that program.

          maybe you should clarify what exactly it is you're trying to do so that people with the proper knowledge can offer you better advice. What type of FFL are you trying to get it? on base? off base?

            Type 1/2 (Dealer) On base (housing not barracks). I understand the rules governing it but I want to know if, in practice, its actually happened on base.

            As a side note, if I were to use my parents house back in Washington, which is my legal home of residence, would my FFL still be valid in California?

              From the sound of it you are wanting to be a "kitchen table" FFL and do it on an active military base, correct?

              You would be asking for an 01 FFL correct? Not a 03 C&R collector license correct? You are trying to make this into a business for you?

              I think that your biggest issue would be if the military would allow you to do this on base. They would be your CLEO in your area since you are on base. You will still need more than just an FFL to do this. You will need a COE, Sellers Permit, and be set up with the DROS.

              Your parents address doesn't matter. Your business address is what does. My brother in law lives in CA and has FFLs in CA and AZ because he has stores in both CA and AZ.

              I think like SOAR said we all need a little more info to help you out.

                Military Bases & Weapons

                One call/visit to the SJA (Staff Judge Advocate) on the base/post and you will have your answer -- the Base Commander will have the SJA staff package before addressing the request. Do not get your hopes up -- expect "no."

                  Sound like a big hassle suggest C&R 03 or wait til you retire

                    You cannot have your FFL on base for many reasons.
                    1 Base commanders consent is required for personal ownership of firearms on base. ( this is for each gun, for gun dealers near base storage is a business opportunity! )
                    2 BATF requires approval of the landlord of address where business is based in writing. NOT POSSIBLE!
                    3 Base rules do not allow a business in housing where foot traffic of any kind is needed.
                    4 A CA business license is required to operate and the question of jurisdiction is impossible to answer. The base will not do it. The surrounding community does not have the authority.
