    Safety Demo

    So we had a customer ship us a Beretta 92 the other day for an interstate transfer. She ordered the firearm and the auction came with a standard capacity 15 round mag. When the firearm came to us there was no mag in the gun or box and according to her they never shipped her a mag as it was not CA compliant. This gun came from J&G sales and I believe her as they are a pretty reputable place and I don't think they would bend CA law at all.

    Ok, enough backstory and time for my question. Since we didn't have her mag I grabbed a 15 round mag from a Taurus 92 that was in our buy room and that worked for her safety demo. My question is what if I do not have a spare mag lying around, what is the best way to go about this? I know the demo has to be preformed on the same gun that go DROS'd. We even have in our customer agreement that it is their responsibility to provide a snap cap or dummy round for the odd caliber weapons that come in. I only bought the mainstream cals. 9, 40, 45, 38sp, 380, 22, and then the basic rifle and shotgun snap caps.

    In the future is there a way if a customer doesn't have a firearm mag with their purchase to do a demo? Any help or suggestions on how the other pros on here do it would be appreciated.

    Without the magazine, you can't do the demo.

    The other FFL can ship you the magazine since the person paid for it, if you have the so-called high capacity magazine permit if it comes from out of state. There is just an issue as to what you can do with it. You could sell it for the person either to someone out of state or to someone who is exempt, for example. You could also modify it to only hold 10 rounds. The law is poorly written, which allows for other options if you have enough time and money, but I would not suggest that.

    I would add to your customer agreement that they also need to provide a magazine.

      Thank you. This was the only time we never had a mag. I do have the HiCap Mag permit, but have never had an issue arise where I needed to order for LEO or something.

      Just checking the Demo has to be done on a firearm that is the same make and model dros'd correct? If I have the same beretta here with a mag and it matches the dros I can still do the demo?

      Never had this issue until today. And when gun came in I wasn't the guy who logged it and when she started her DROS paperwork I would have told her then, but I guess one of my guys didn't. It worked today BC I had a spare mag that fit. Dumb luck!

        Yes, if it is the exact same model, then you can use the other firearm.

        Often the person buying the firearm knows someone out of state who might want the magazine, instead of giving the seller a free magazine. Sometimes the seller will discount the price, but often they won't.
