I need some help to clarify a hypothetical situation. The buyer is in CA, and need the CA compliant long gun they are buying from an out of state private party shipped to the FFL for proper transfer. I am fairly familiar with this process, similar to the thread here:
But my question is this: When asked about it, the FFL is willing to receive from a non-ffl, but was told by the DOJ on the phone that he needs to receive the gun, and then it has to go through the 30 day wait, similar to a consignment sale while the property is checked that it is not stolen. He also told me there is some new system that DOJ started requiring just this year for FFL's to enter the source of firearms, and that since the source is not an FFL, that it was somehow more problematic.
I believe there is some confusion here, because my understanding is that it is exempt from the CFLC since seller/shipper is a non-ffl. Since its a long gun its obviously roster exempt. And that the seller's ID is used to log in the source of the firearm. And lastly that it is a 10 day waiting period for DROS once the Dros is started.
I looked on the FAQ page for DOJ and stickies here and haven't found exactly how this is to be handled, so can someone please help me clarify this. We just want to be sure we do everything correctly. Thanks.
