    MO to CA Used handgun purchase

    I've a customer who found a used S&W 645 on gunbroker, he would like to purchase it and have it sent to me as his FFL in CA.

    Can I except this model handgun?

    The listing states the seller has to collect tax in MO at 7.975%, would I have to charge him CA tax when I transfer it to him?

    Yes, you can accept it, but the real question is whether you can transfer it to the person. In order to transfer it, the handgun has to be on the certified list or the person has to be exempt. I don't see a S&W 645 on the certified list, which could be an issue.

    You would need to collect sales tax for CA, but the MO seller should not collect sales tax since it is an out of state sale.

      Thank you sir. Much appreciated. I've let him know and he has now purchased a similar model that is on the certified list.
