Family transfer of handgun on site

    Family transfer of handgun on site

    I would appreciate any competent help


    Scenario: Daughter and Mother come in to store with handgun. Daughter is visiting parents, brought handgun, wants to transfer to mom. Mom is resident of CA, daughter is resident of Minnesota.

    I have done family transfers of un-rostered handguns sent to our store from out of state from an FFL, so I am familiar with the requirements (gift letter, copy of ID), however just want to be sure what they requested can be done or not.

    And one more thing, can handguns be shipped from the owner direct to our store, without an FFL intermediary?

    It is definitely legal, but your major problem will be that California dealers don't have a clue how to do it. They just say for you to just use the interfamily transfer form and send it to the doj with 19 dollars. WRONG! It should be easy to have your out of state relative walk into a California FFL to do the DROS, but I have tried with several and none know the proceedure.

    Anyone have a good FFL that is competant enough to do it?

      If I read correctly, OP is an FFL and willing to do it if it's legal.

        Do it as an out of state interfamilar transfer.

        Yes, it is legal for a non FFL to ship a firearm to a FFL for work or transfer. However, many FFLs have policies against this. If you choose to accept non FFL shipments, besides being an awesome FFL, you're going to be in for a few headaches. Sometimes shippers don't include a copy of their ID or any explaination of why they shipped the gun to you. This can be a real PITA but, again, if you're willing to deal with the potential frustration, you are one of the more awesome FFLs in the country!

          It is done the same way. Just pretend the gun was shipped in. Once the firearm is in your inventory, you just do a dealer transfer (not a PPT) to Mom. (It is still roster exempt). I would still have the daughter sign a letter saying it was a gift for the file, just in case for a DOJ audit.

          Yes. No FFL is required to ship you a handgun. You will still need the owners personal info for your A&D book.

            As said, it is the same as if it was shipped to you, but easier since you have the ID and can get the letter saying that it is a gift from the daughter to the mother.

            As others said, there is not requirement that firearms be shipped through a FFL, but I would suggest that you get a copy of the person's ID before you give out any of your information. It is much harder to get it afterwards and there have been FFLs who have received firearms with false information (name, address), so if the person won't give a copy of their ID in advance, most likely they won't include it with the firearm.
