    Form 4473, Section D

I am sorry to bother my esteemed colleagues at CalGuns with such a stupid question, but I am confused. Scenario:

--Person in California orders a rifle from an online dealer out of state.

--Purchaser finds a California FFL and has the rifle shipped to him.

--FFL provides buyer with a 4473 form before DROS'ing the rifle.

    Question:

I am assuming the FFL who received shipment for the buyer should completely fill out Section B and Section D on the 4473 form. Item 31 on the 4473 form ask for the "Trade name and address of transferor (seller)" and Item 32 asks for the FFL number. Items 33-36 are for the Transferor's/seller's name, signature, title, and transfer date.

Obviously, the seller is out of state and isn't going to fill out any part of the 4473, right? The California FFL fills out all of Section B and Section D, right.

    Thank you!!!!!

yes, as far as ATF is concerned, the FFL doing the transfer to the buyer is considered hte seller as far as it applies to the 4473. so, yes, the CA FFL fills out B&D.

Do you want an AOW or C&R SBS/SBR in CA?

Correct--the receiving FFL (In this case the Ca FFL) fills out those sections.

In this case as far as the ATF and CA DOJ is concerned you are the seller, that's why you must collect the CA sales tax.

The money is not the issue in terms of the transfer of a firearm. The FFL who does the actual transfer is considered the seller/transferor. Where is came from does not matter.
