    Stripped Lower Family Transfer

    I am going to begin paperwork for a stripped lower I purchased soon, however I am building this rifle for my father. Do I do the paperwork in my name, or how does this process work if I originally purchase the lower but the ownership will be for my father?

    Presuming your father lives in CA ...

    Intrafamilial transfers are not an FFL question - the whole point of that in CA is to avoid using FFLs.

    You buy, you build, you give to your dad (or sell it to him). If that happens in 2013, no paperwork required. If it happens in 2014 or later, a revised version of the OPLAW form will be needed - dad fills it out and sends it in.

      Are you giving it to him as a gift? If so, then you can do the transfer. If not, then he needs to the transfer. There is an exemption for gifts, but not if he is buying it from you since then it would be considered a straw purchase.

        Yes, things change if both people don't live in CA, but other aspects don't change.

        There is no intrafamilial exemption under Federal law. So, if the father is planning on buying the firearm from him, it could be considered a straw purchase since that is the plan in advance. A gift would not be.

              Yeah he's going to purchase the parts for it, I just ordered the lower. I'm going to guide him through the build and it will be complete before Jan. 1st 2014.
