    Sold AR

    A few years ago I took an AR and left it with a friend in Idaho so I could fly up there and go shooting without trying to transport it each time i went. Now I don't go up there anymore and he wants to buy it. Idaho has no restrictions on Private party sales. Can he just send me the money and is it legal for me? Thank you, Rod

    As an FFL I only keep up with firearms laws in California since I only do business in CA. When I seel guns online I ship to another dealer and leave it up to them to be sure that all local laws are followed.

    That being said. Unless someone on here is also a dealer up in Idaho I doubt many will know the laws. I think your best bet to get the correct information would be to call a local firearms dealer in Idaho and get clairfication. See if the state of Idaho has something like our DOJ here in CA where you can call and get questions answered.

    Being a resident of Arizona myself I know what you mean about PPTs not being needed to go through a dealer. Where I have never done that I know people who do and they just write bills of sales sign and date. Problem is proving 20 years down the road you sold that firearm if you lose your bill of sale if that firearm ever comes back to you somehow.

      No, since it is a transfer between residents of two different states, it has to go through a FFL in the buyer's state of residence per Federal law.

        Kemasa, thanks for the reply. So does he just take the AR to his FFL and have it put into his name before he pays me? I don't want this coming back to me 10 years from now. Thank You, RB.

          Well, actually it should come from you to the FFL. Your friend should not really have access to it as that could be considered a transfer between out of state residents.

          He would need to ask a FFL up there how they want to do it, if they want to be involved at all. Normally it would be shipped or brought in by you. The FFL might accept that it came from you, if you perhaps included a copy of your ID/DL or they might not.

          The best way is for you to go up there and do the transfer. Anything else the FFL might have issues with, but maybe not.

            Thanks, maybe I'll just keep ownership till I go up there and then do a FTF in a gun store.
