    CFLC Question for FFLs

    Ok, so we haven't had this situation happen yet but we were discussing this today and we have a question for all the FFLs out there.

    What is the proper procedure for handling a firearm that is transferred to us from an out of state licensee that does not include a CFLC printout with the firearm? Can we still DROS that firearm to our customer if its a gunbroker purchase? Can we call and have that FFL send us a CFLC after receiving it?

    I know ATF wants all firearms logged into the book but can we still transfer that gun?

    Again we haven't had this come up yet, but we had a "what if" discussion today at the shop and we are deferring to all you.

    You must log the firearm per Federal law, although my understanding is that the CA DOJ says you cannot. The selling dealer must provide the CFLC letter or number. After you receive the shipment is fine. If they refuse, you must return the firearm to them. It cannot be transferred without the CFLC info.

        It depends on who you ask (BATF vs. CA DOJ).

        You do not need the CFLC letter, only the number, but with only the number you don't know if that number is really for you nor what they claimed to ship. I had one place use my CFD number for the number of long guns sent, which I would not have known if I did not have the letter. Another place shipped an AR lower and claimed it was a handgun because there was no "other" and that seemed to him like it would be better. He did it twice and both times he had to correct it.

        The CA DOJ says to not log the firearm in, the BATF requires that you log it in by the end of the next business day or in 7 days if there is paperwork with the firearm that has all of the required information on it.

        The CA DOJ says that you have to return the firearm within 24 hours, but you can't do that if you don't have a copy of the FFL of the shipper.

        You can get the number/letter after you receive it. I have also heard it said that the CA DOJ does not have a right to see your bound book, which makes it difficult for them to know that you received a firearm without the letter if it is not transferred.

        The CA DOJ claims that if you log the firearm in, then that means you intend to do the transfer, which is a false assumption on their part.

        NO!

        Yes.

        No, you can not transfer the firearm, but you need to follow Federal law and log the firearm. CA can not demand that you violate the law under which you are licensed. Another example is copying a Federal ID for CA.

          Practically speaking, get in touch with them and get a number. I have yet to fail to receive a number.

          If you can't get one, then call the DOJ and ask them what to do.

          Kemasa has it all down, but I didn't want to read that much this morning.
