    30 day wait

My Cousin bought a Glock at a Sacramento gun shop. He wanted to buy a AR receiver they had, but the guy at the store told him he had to wait 30 days to buy the AR lower because he bought the handgun. I thought you could buy a pistol and a rifle at the same time. Is the gun store guy correct ?

I think the shop was confused 1 in 30 is only for new handguns so you can buy 1 handgun and as many long guns you want per 30 days
Laws that forbid the carrying of arms... disarm only those who are neither inclined nor determined to commit crimes... Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man. Jefferson's "Commonplace Book," 1774_1776, quoting from On Crimes and Punishment, by criminologist Cesare Beccaria, 1764

The 1 in 30 only applies to handguns, so the store was wrong.

That's what I thought. Just wanted to make sure so I don't pass bad information. I told him to go back and ask for the owner or another clerk if possible. Thanks.

Howany pistols can you PPT in a thirty day period? Does the 30 day wait apply only to new guns? I'm trying to buy someone's personal weapons.

As many as you want. Does not apply to ppt's.

outside of the city of LA, as many as you can pay for.

it applies to new and used handguns but PPT transfers are exempt.

Do you want an AOW or C&R SBS/SBR in CA?

the 30-day rule does apply to used handguns. you can't buy or transfer through a dealer more than one used handgun in 30 days.

Do you mean a shop owned gun? It is my understanding that a consignment gun is also exempt from the 30 day rule.

It depends on how it is transferred. If it is done as a PPT in the DROS system, then it would be exempt, but if it is done as a dealer sale (which is normal for everything except a non-roster handgun) then the 1 in 30 would apply.

He probably thinks it's the same as a handgun but a stripped lower is just an "other".

Thanks for the correction. Edited as to not spread any more fud.

That is not correct. A consignment can be done as a PPT, which is required for an off-roster handgun, which would then be exempt from the 1 in 30. Other than that, the 1 in 30 would apply.

Also, if you have a C&R FFL and CA DOJ COE, you are also exempt from the 1 in 30, but while the CA PC does not have any limits with respect whether the handgun is a C&R or not, the DOJ is saying that it only applies to C&R handguns (because that seems to be what they want it to be, not what it is).
