DOJ delay question

Hey ffls hows it going? i bought an AR on feb 1 and was notified on feb 8th about the delay. So my question is i bought the gun on my wifes and i credit card so we both technically paid for it. if i am denied for some reason or the hold lasts to long can i transfer sale to her? i dont want it to look like a straw purchase or anything. she herself owns a glock and has a handgun safety cert and also wanted the gun. thanks

The delay can last several days or several months. Yes, you can cancel the DROS. I don't know if the wife then doing a DROS after, would not bring up a red flag. I would tuff it out. Sometime in the future, you will want to buy another firearm. Doing the needed corrections now, would make it much less difficult.

I've been on delay for 10+ WEEKS now. Every document they requested has been faxed to them the day after the delay was put in place.

Since then I was not able to get even a remotely coherent response from the person who supposedly handles my case. When I called last Friday, I was told that they are just starting to go through cases that were put on delay in SEPTEMBER of last year.

Your wife attempting to re-DROS in her name will definitely raise a red flag, because she most likely has the same address as you do and you don't really want to get her arrested for making a straw purchase...

If you're not prohibited then there's probably some snafu with yer ID. If you are truly not prohibited you could cancel and have your wife DROS it, but be prepared for the FFL to tell you he won't do this if he doesn't know you well.

He's obligated to sniff out a straw purchase, submit one knowingly, go to jail or face fines, lose FFL, etc....

Also be prepared to pay another $35 bucks.

If you are delayed or denied, it would be a very bad idea for all involved to have a spouse submit the DROS as it would most likely be considered a straw purchase and even if they don't charge someone, it could be a pain.
