Do 03FFLs need to fill out a 4473 when getting a C&R handgun from an 01FFL CA dealer? DROS yes but 4473?

I just asked that question a couple weeks ago http://www.calguns.net/calgunforum/s...d.php?t=638907 .
seems that it isn't legally required and some FFLs realize that you shouldn't fill out out since that just adds the chance of an error on the 4473. others use the 4473 number to sort their paperwork so they make everyone fill out a 4473Jack

Just because some FFLs do it does not make it right. The C&R FFL holder is a licensee and the 4473 is for non-licensees, so no 4473 is required.
Incorrect, depending on what you mean. If you are selling the firearm to the person, then there is sales tax, if the firearm is coming from a business, then there is sales tax. The C&R FFL holder is not a business, so they are not buying it for their business.
If the C&R firearm is coming from a private party and is an occasional sale, then no sales tax is due. I think I posted the BOE letter to the CA sales tax FAQ about this.Kemasa.
