Selling a 50 BMG

I want to sell my McBros .50 BMG, TAC-50. Its registered with Calif DOJ. I found a dealer in Reno that will handle a consignment sale from a Californian.

My question is if for whatever reason (like it doesn't sell) I wanted/needed the rifle back what is the process? The Reno dealer told me because its from an out of state resident it can only be sent/returned to a FFL in Calif (its not a repair). The Reno dealer said if I was a Nevada resident it would be an easy return. The recovery of the rifle is then between the Calif FFL and myself. Does the rifle need to be returned to an Assault Weapons licensed dealer or can a "regular" FFL return the rifle back to me?

I looked at the DOJ web-site and couldn't find an answer.

If it is being returned through a CA FFL dealer...

It is not legal for a CA FFL dealer to accept/transfer an assault weapon, unless they have an assault weapons permit.

Therefore, a CA FFL dealer with an assault weapons permit would be needed.

The easiest way would be to deregister it as an AW. Then, remove the barrel. At this point, it would not be a 50 BMG. So, the FFL could send you the everything except the action and send the action to a CA FFL to transfer back to you. The only catch is that you could no longer install a barrel on it chambered in 50BMG. You could always get a new barrel chambered in 510 DTC to use in CA.

Which Reno FFL? I know a few there and have strong connections to a few more. If the Reno FFL has any concerns as to the legality of this, he can contact me via PM here or on the FCSA visitors forum and I can try to put his mind at ease.

There really is no way to do this. Either decide you want to sell it or you do not. Might I recommend trying to sell it yourself online and once it is paid for, then send it off and be done with it. Do you really think a Reno gun store is going to get more traffic than an online ad or Gunbroker?

He is correct, if it is not being sent as repair, he must send it back to an FFL. It is going to have to be an assault weapon FFL and the generally don't do anything cheap. I am not sure if they can re-DROS it to you being an assault weapon, even though until you cancel the registration, it is still in your name. Maybe the AW dealer can pawn/co-sign return DROS it to you. Again, that is going to probably be expensive.

You can also call the DOJ and see what they recommend.
