    LEO status?

    Just got this email from a potential client:

    I am with the DHS as a Behavior Detection Officer with the TSA.
    Federal Emergency Response Officer.
    Is this considered a LEO?
    Is he roster exempt in California? Thanks!

    Before opening my shop I worked for a local PD as a Corrections Officer... our status was slightly different (830.55) than a standard full time PD (830.1). Although the difference was slight (PD status on/off duty).. I was allowed to buy off roster and also hi-cap mags... as always I needed a letter from my commanding officer to pick up a weapon before the 10 day wait.

    If the ID has the standard "The person identified on the front side of this card is a PEACE OFFICER under CALIFORNIA PENAL CODE SECTION 830.*" blah blah blah you shouldn't have a problem.

    From my understanding the ID must read PD and have the PC on the back.

    Just my 2 cents from limited similar experience.

      If he has to ask, he isn't. Or forward it to the DOJ and let them make the call. Or go single shot exempt.

      I hate all of the people that want to be LEO for handguns and you have no way of knowing without going through all of that complicated 830 crap.

        No longer have an FFL, but the question caught my attention. I looked at TSA's job description and my guess would be no, the person is not exempt. The job description is basically a screener's position. Now granted I haven't been flying much recently but I don't recall seeing any of the TSA screeners armed. It is usually locals who are armed at the screening locations. Here is the link to TSA's job description, note that is says at the bottom not covered Law Enforcement retirement, don't see anything about attending FLETC either.

          I have no ideal about this particular individual. But to help you out a little if the party is Federal all the 830 PC stuff will not apply, it is for California only.

            He's not a LEO. TSA has very few armed positions, for the most part, only their special agents & FAMs carry weapons.

            A Behavior Detection Officer is just another one of the blue shirt TSA guys that have been trained to watch for special behaviors which could cause them to think you're up to no good (body language, nervousness, etc.)

            All TSA personnel are Federal Emergency Response Officers, as are most federal workers. Sorta like the old Civil Defense Worker; when the bomb is dropped you're ordered back to work.

            I'm not a FFL, but I do know he's trying to take advantage of some fancy titles.

              Inquiry about his series/grade might help, but i’d take 10%’s idea and just kick it up to CADOJ.

                I would say NO!
                TSA only has a few armed positions and the position described above is not one of them.
                They have no LE authority and do not carry while on duty.
                But most importantly is that posses no LE authority.

                      BDOs with TSA are not law enforcement in any way shape or form. They require a LEO to step in to take action if they clue in on an individual with a behavior. They are not exempt and they are strictly administrative with no powers to arrest.

                        Federal law enforcement officers are not peace officers per ca law as they are not employed by the state of ca. However federal LEOs are still exempt
                        from roster, mag capacity etc. they do still have to wait the 10 days unless they possess an agency letterhead stating for duty use which would be rare as Feds are usually issued their sidearm.
