Intra-familiar/ long gun?

My brother owns a Remington Model 770 (currently for sale). Here's the deal, he's an unemployed vet, with no transportation currently.

He'd like me to try and sell it for him, but I have a question I'd like to figure out first, before helping him out.

I've heard about, but never been party to an intrafamiliar transfer. As I understand it (which I'm probably wrong), he could transfer the gun to me (his brother), without doing paperwork and paying fees.

Is this correct? Can he simply "give" me the long gun, and then I can sell it via a PPT at a local FFL to whomever I choose?


Since my brother doesn't drive currently, it'd be a pain in the buttocks to have to go pick him up, then, drive him to the FFL to meet the buyer, and wait while he does all the paperwork. I'd do it, if I absollutely have to, to help him out, but I'd like to avoid all the extra driving if possible.

Per CA laws, the intra-familial firearm transfer exemption is only between a grandparent - parent - child - grandchild.

It does not apply to siblings.

Your brother will need to be present in order to sell/transfer his firearm via PPT.



Penal Code 27870
Section 27545 does not apply to the transfer of a firearm, other than a handgun, by gift, bequest, intestate succession, or other means from one individual to another, if both of the following requirements are satisfied:
(a) The transfer is infrequent, as defined in Section 16730.
(b) The transfer is between members of the same immediate family.
(c) This section shall remain in effect only until January 1, 2014, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2014, deletes or extends that date.

Penal Code 16720
As used in this part, "immediate family member" means either of the following relationships:
(a) Parent and child.
(b) Grandparent and grandchild.
