    Off roster transfer to CA

    I'm sure the answer I need is out there, but I haven't found it yet.

    I have a customer that moved here from Pennsylvania and is now a California resident. He left a few guns behind and now wants his brother to ship them out here. The gun in question is an older S&W 66 2.5". The gun is his already, legally owned in PA, simply stored with his brother. What I want to know is can I transfer it to him as roster exempt since it is already his? Obviously I would need a signed declaration of facts saying it is his gun. Second question, would DOJ accept this in an audit or would I get popped?

      The easiest way to do it is for your customer to pick up the guns on his next trip back to Pennsylvania and bring them back to California as checked baggage on the plane. He would then just have to mail in the "new resident" registration form to CalDOJ for any of the handguns.

      If he doesn't plan to visit Pennsylvania anytime soon then it gets more complicated.

        I would call the DOJ.

        As far as I know, it would not be roster exempt.

        I would have him mail his own firearms to himself out here. That is perfectly legal and it doesn't involve you. Then he new resident registers them. $19 each and that is cheaper than whatever you were going to charge him.

          He could ship them to himself, but that also means that he would need to go back there.

          Personally, I would not do the transfer since it would be hard to really document that the firearms are really his. The firearms were not given to you to repair or anything, so the return to owner would not apply.

          You could check with the DOJ, as other have said, but then again the DOJ has been known to tell people that they can get a firearm from a parent who lives out of state and just fill out the CA form, so I would only trust a written statement for this transfer.

            Alright, I think I'll just tell him to bring when/if he goes to PA. He has no plans to go now, but he has family there, so eventually he will probably go.

            The roster is so frustrating. Does anyone know where the lawsuits stand? I haven't followed that topic lately.

              another question.....similar

              I was having the same issue pop up as well. Off roster Taurus 608 from father in OK to son in CA. I told him to let me look into it first. has anybody successfully done this?

              Same thing with a LWRC REPR 7.62x51 20" barrel, just moved here from nevada and has this rifle, he wanted to register it, would it be banned per the weapons control act of 1989? Or do i just install a bullet button and poof, legal?

                I am not sure of the current status, but in the past the CA DOJ has said to transfer an intrafamilial transfer as exempt. You need documentation for your records.

                So-called a-salt weapons can not be registered now. If it is in a configuration which makes it banned, then it is illegal and was illegal to bring it into the state. It could be taken apart, then it is not semi-auto anymore, but I would not personally touch it if it meet the definition of a so-called a-salt rifle. The person could install the bullet button, but unless you are an AW dealer, you can convert one legally.
