    collecting tax

    Buying a used gun from an individual out of state. He has to send it via FFL to FFL here. Is this subject to the FFL here collecting my tax?

    I am being told mixed answers and want to know for sure. I thought I recall tax being collected when its brought in to state from buying through a dealer brand new.

    Cali BOE has recently instructed FFLs to collect tax on all interstate transfers regardless of the source. Purchases from private individuals were previously exempt, but BOE has changed the guidelines.

        This is NOT correct as I posted a recent letter from the CA BOE. If the firearm is a C&R handgun and the buyer has a C&R FFL and the seller is a private party, it is an occasional sale and not from a business (would have to check on shipping through a business), then it is not subject to sales tax.

          C&R is for old guns right?

          This is on a handgun bought from an individual on gunbroker who had it registered to himself and then I bought it. Stupid thing is that there will be no paper work for sale price or anything because its not a dealer or business. I guess its up to me to declare the value to the FFL on my side.

            Incorrect. Relic is old guns, Curio is typically a newer gun with value/interest based on some aspect to it. Look at the first firearm on the C&R list, which is not over 50 years old.

            If it was bought through gunbroker, then there is a record of the auction with the sale price. The seller can write up a receipt as well and is better than your doing it.
