    Dual Resident

    I have a customer who is a dual resident of Nevada and California. He has a Nevada DL so currently a DROS is impossible. Can he obtain a California ID card to legally purchase firearms in California?

    Yes. A CA resident can have both a CA DL and a CA ID, so there is no restriction with respect to the DL that I am aware of. I know of others who have a CA ID and a DL from another state.

      Lets flip this...can a CA resident get a NV or AZ ID and purchase a gun there?

        Yes, but you had better be a resident or otherwise you are asking for a lot of problems. It is possible to get an ID without really living there and if you do that to get firearms there are several laws which you could be violating, such as false statements on a 4473, transfer of a firearm to a resident of a different state, etc.

        If you get caught, then you might not be able to own a firearm ever again, so you should do things right instead of what you might be able to get away with.

          Not sure about AZ.

          NV DMV will not issue a NV DL/ID unless the applicant surrenders their previous state's DL/ID.
          If you want to retain your CA DL, then NV DMV will issue a Seasonal Resident ID.

          Per NV laws...
          The NV Seasonal Resident ID is not proof of NV residence and NV FFL dealers can not transfer firearms to a person with a NV Seasonal Resident ID. Any firearms bought by a NV Seasonal Resident will be shipped to a FFL dealer in whatever state that Seasonal Resident holds a state DL.

            I am in FL often enough to seek out residency there, and maybe store firearms there that I buy there. Trouble is the Class III stuff I want.

              Nevada ID requirements:






              Nevada Revised Statutes 482.103 and 483.141 "Resident" defined.

              1. "Resident" includes, but is not limited to, a person:
              1. Whose legal residence is in the State of Nevada.
              2. Who engages in intrastate business and operates in such a business any motor vehicle, trailer or semi trailer, or any person maintaining such vehicles in this state, as the home state of such vehicles.
              3. Who physically resides in this state and engages in a trade, profession, occupation or accepts gainful employment in this state.
              4. Who declares himself to be a resident of this state to obtain privileges not ordinarily extended to nonresidents of this state.
              2. The term does not include a person who is an actual tourist, an out-of-state student, a foreign exchange student, a border state employee or a seasonal resident.


              You cannot hold both an Identification Card and a Driver License, even if they are from different states. Nevada has a seasonal resident ID for those who reside in the state only part of the year.
              Seasonal Resident ID Cards

              NAC 481.005 - A "seasonal resident" means any person who is not a "resident" as defined in NRS 483.141 and who:

              * Temporarily resides in this State for a period of at least 31 consecutive days in each calendar year;
              * Maintains a temporary residence in this State;
              * Returns to the state or jurisdiction of his residence at least one time during each calendar year;
              * Is registered to vote or pays income tax in another state or jurisdiction; and
              * Does not engage in a trade, profession, occupation or gainful employment in this State.

              Seasonal resident identification cards are marked with a designation that the holder is a seasonal resident and is licensed in another state.
              Arizona:

              Arizona does not seem to be as strict, but you can't have an AZ ID card and an AZ DL.





              Resident Definition

              State law requires that you obtain an Arizona driver license and registration immediately if any one of the following applies. If you:

              * Work in Arizona (other than for seasonal agricultural work)
              * Are registered to vote in this state
              * Place children in school without paying the tuition rate of a nonresident
              * Have a business with an office in Arizona, that bases and operates vehicles in this state
              * Obtain a state license or pay school tuition fees at the same rate as an Arizona resident
              * Have a business that operates vehicles to transport goods or passengers within Arizona
              * Remain in Arizona for a total of seven months or more during any calendar year, regardless of your permanent residence

              Out-of-state students enrolled with seven or more semester hours, are not considered Arizona residents, regardless of employment.

              Active duty military personnel based in Arizona who qualify for exemption under the Service Members Civil Relief Act of 2003 are not considered Arizona residents.

                Not to accelerate thread drift, but AZ will issue an ID card to just about anyone. The important thing is meeting the ATF definition of resident which is less than most people realize.
