    COE Privileges

I am not sure this is the proper forum, but here goes.

I recently purchased a handgun(XD9 tactical) and I am in the waiting period. I asked if the COE had any benefits as far as the dealer was concerned. The store rep said no. I asked if that included the exemption for more than one handgun in 30 days. His response was that "that was recently repealed by the legislature". Being that that this is an otherwise awesome local shop, I declined to argue because I was not sure.

Has anything changed as far as COE privileges are concerned?

A Glock 17 is in the balance here!

    Thanks.

With COE/FFL07 you are exempt from 1 in 30. It has not been repealed. They are just confused.

I purchased 6 handguns in 30 days between March and April. Three of them would have fallen under the 1 on 30 rule. I have a FFL03 and a COE. I didn't have any problems except one shop who called the DOJ to confirm and they told him no unless it was a C&R handgun. Fortunately, I just made sure the other transactions had the exemption put in and no problems. None of them were C&R firearms. Sounds like BS to me. If they have changed the law I'd love to see it.

The law has not changed and they are confused because they tried to say that it was only for C&R firearms, but that is not want the law is and it is NOT using a C&R FFL when you have a C&R FFL and a COE for the 1 in 30 exemption for modern firearms.

As I understand it, the CA DOJ Director of Industry Operations is aware of this, so if you get a DOJ person who says otherwise, tell them to talk to the DIO.

Yes, I even showed the shop the law in the book but, they couldn't be bothered. Mindless drones incapable of independent thought. I don't blame them for wanting to protect their license but, it is frustrating. To top it off they made me buy a cable lock even though I'm exempt from that as well.

Thanks for the tip about the DIO.

How are you exempt from the lock requirement for both CA and Federal?

              PowayBob,

One of my employees just pointed me to this post and told me it was he that made this statement. He thought he was right, but I explained to him that he was incorrect and helped him look it up and research it for himself. He now knows what the difference is in this scenario.

My guys know a lot, but don't know everything. We are all committed to doing our best and not putting out FUD. So, on behalf of the shop, I apologize. Your COE does get you what you want since CA makes no distinction.

              Again, my apologies.

Just having a COE does not help when buying guns. You need another type of FFL, most people use an FFL03 and COE to bypass the 1 in 30 requirement. The problem is that CA allows this with a FFL03 +COE but the feds said a FFL03 can not be used to buy new guns. Because it is a CA restriction they can use what ever they want to bypass their own law. You are not using the FFL03 to buy the gun, you are using the combination of documents to beat the 1 in 30 requirement.

I think that your statements are going to confuse people.

From what I know regarding the BATF and the C&R FFL/COE exemption to the 1 on 30 is that they don't care at all since it is not considered using it (no bound book entry or anything), the same as getting a discount from a vendor when you have a C&R FFL.

CA tried to claim that the BATF had an issue, but that was bogus.

My FFL is willing to do a second-in-30 DROS for me, but he showed me the DOJ web page and the only exemption selection is LEO. There was no selection for any other kind of exemption. Anyone know how a FFL 03 + COE handgun exemption should be entered into the CA DOJ system?

Those are three separate boxes. CFD is California Firearms Dealer, which is not LEO.

That screenshot is from the dealer sale button. The DROS system is from a web page, so it should all be the same.

The main page for the DROS system is:

That's what he showed me and he said for a new modern handgun the only 2 choices were Peace Officer or Handgun. Now I know that it's the the Curio/Relic/Olympic Pistol/Exempt button that he needs to use. Thanks!

If the handgun is a modern gun, not a C&R, then the handgun dealer sales needs to be used. All of them have the waiting period exemptions, which also include the 30 day exemption.
