SSE and FFL issues

You mean like the BOE changed the rules regarding collecting sales tax from out of state private parties?
The correct way would be to get the law changes, but we all know that is not how it is always done. We can talk about what the law actually says vs. how it is viewed and enforced, even on issues we don't agree on. I have yet to get an answer from the BOE regarding sales tax on a C&R from out of state from a private party to a CA C&R FFL holder with a COE.Kemasa.

I am sure that they can come up with something and I don't really want to give them any ideas. You don't think that they can tell FFLs that SSE are not allowed under the basis that it is just an attempt to bypass the law or something like that? It does not have to be illegal, they just need to scare FFLs into not doing the transfers.
What would the law with respect to high capacity magazines and the exemption specific to FFLs. I don't see a limit as to who the magazine could be sold to, yet the DOJ says you can't and makes all sorts of claims, but never backs it up. So tell, is it illegal under the CA Penal Code to sell a high capacity magazine to an average citizen? If so, what is the law that is being violated? If you say 32310, look at 32410.
So, do you really want to try to make the argument that the DOJ won't try to do something without changing the law? If you call and ask them about a SSE, guess what the answer will be?Kemasa.

Still apples to oranges. Show me in writing these things from the DOJ. The BOE has made written statements of how they interpret the law. The DOJ only has FUD. They don't prosecute and they don't back it up in writing.I am sure that they can come up with something and I don't really want to give them any ideas. You don't think that they can tell FFLs that SSE are not allowed under the basis that it is just an attempt to bypass the law or something like that? I stand behind my statement. The DOJ will not be able to do anything about SSE. The worst they can do is start a FUD campaign.
However, market forces will take care of those too scared to follow the law. That is why I am not the only guy selling AR15s anymore. As more and more dealers SSE pistols and nothing happens, other dealers are going to follow the money.
There is nothing the DOJ can do about it. The legislature can, but I doubt fixing the single shot exemption is a high priority.www.tenpercentfirearms.com was open from 2005 until 2018. I now own Westside Arms.Comment

Answer the question I asked. It is the same thing, a view which is forced without backing of the law. Make a lot of money and sell the magazines to anyone and see what happens. I think that you would win in the end, but in the meantime, you could have serious issues, which makes it not worthwhile to push the issue.
That makes it the same since the law appears to be one thing and the view another, same as what they could try to do in this case.
Hopefully so, but who knows what they will do.The BOE has made written statements of how they interpret the law. The DOJ only has FUD. They don't prosecute and they don't back it up in writing.
FUD and harassment, which is doing something. You are far more optimistic than I am. I was surprised with the OLL as I expected them to do something stupid, such as trying to get all of them listed as so-called a-salt weapons.I stand behind my statement. The DOJ will not be able to do anything about SSE. The worst they can do is start a FUD campaign.
Also, there are areas (not sure about this case), where they can make rules as defined under the law.
Yes, but in this case there are the rules of the BATF, which are a bit unclear to me, but from what I heard could be an issue (just have to follow the rules, not that it would stop anything). I am not sure if the DOJ could get the BATF to push things or if there is any way the DOJ could try to cause dealers to enforce something. However, market forces will take care of those too scared to follow the law. That is why I am not the only guy selling AR15s anymore. As more and more dealers SSE pistols and nothing happens, other dealers are going to follow the money.
I am not sure if they would be able to get it to pass, but perhaps. I think that it would raise issues and that many would not want to get into that arena. There is nothing the DOJ can do about it. The legislature can, but I doubt fixing the single shot exemption is a high priority.
Remember, some of the laws allow the DOJ to make rules and that IS the law.
I do hope you are right, but I also don't know that you are correct about the DOJ and what they will or will not do.Kemasa.

If the DOJ tells you this, please contact CGF or CAL-FFL as we would be very interested to hear it. I would give the DOJ a little more credit than that as a "spirit of the law" is no justification for anything and most people know it.
Other than that, FUD is the only thing stopping anyone from doing anything. Again, market forces will slowly change that as people don't go to jail and make money while doing it.
