    Type 1 FFL and used guns

    What are the Cal DOJ rules for selling used guns? I would need a secondhand dealer license correct? Am I good to go if I receive the used gun from another FFL instead of individual?

    You will need a secondhand dealer license and FDAS access for any used gun you purchase from non-licensees for your inventory.

    Effective July 1, 2010, Section 21628.2 requires secondhand dealers and pawnbrokers to electronically report firearms purchased, taken in pawn or accepted for sale on consignment, or accepted for auctioning to the California Department of Justice (DOJ).

        Yes, that would be my understanding. Probably would be difficult to process the FDAS if the FFL wasn't standing in front of you, e.g., thumbprint, copy of DL, signatures, etc. If the other FFL took it in from a private individual, I would expect him to have done the FDAS.

          How about if you receive a "new/unfired" from non-licensees, do a secondhand dealer license & FDAS still apply?

            If a non-licensee has possession of it, I don't think it is considered new, unfired perhaps, but not new. I'd do the FDAS.

              So, I need to enroll in FDAS only?
              How about the Secondhand Dealer License, I think I applied only for Type 01 when I did the application & did not check "Yes" on the box of question #10 where they asked "Do You Intend to Engage in Business as a Pawnbroker?"

              I haven't done anything yet with my license, just learn the scenario to make sure everything is legal. Thanks.

                To enroll in FDAS you will need a Secondhand Dealer License. This should not to be confused with a Pawnbroker License (all sorts of other financial/paperwork hoops to jump through). My local PD issued my Secondhand Dealer License for the CA DOJ.
