I bought a gun at a pawnshop today and it took about 4 minutes? I had my registration and he said it wasn't needed for PPT as this was on consignment! He also said I didin't have to pay sales tax, so got for 899 plus $25 DROS; I was amazed?? It was so different than the last PPT I did at a Turners that took forever and pages of questions. This was all writtenn on a generic "Purchase order" form with just a thumb print, price and DROS??? what is the deal??? Thanks

Technically they are NOT supposed to say that about the tax! I asked them if they would discount the gun and they said that " They could only discount it as NOT charging me tax" and none is reflected in the paperwork, so I know that is illlegal really as I have a resale license myself!! Years ago I bought things from a guy I got to know at a pawn shop and it became "cash only,no tax'" kiind of deal, but I didn't think they would put it on auditable paperwork! No lock either; just bring in the paperwork and pick it up on the 16th!!!Comment

as a business you dont have to charge the customer tax, but that does not mean tax is not paid, you are still liable for the tax on the sale, whether its on the receipt or not
home depot/osh come to mind as I can think of their commercials, and other major stores do it all the time, but they still have to pay the tax on the sale in the end.Comment

Well technically it HAS to show on the customers paperwork!! Home Depot as your example would charge you $500 and than "back" the tax out and put it back on the receipt so it equalled $500, because having a Resale license mandates you "collect" tax unless the customer has a resale license on file with you!! This was not done, but it could be done on the "consignment" paperwork and hope it flies if audited!!Comment

It sounds like the place is looking for problems. They have to follow all of the same rules as any other FFL, including sales tax.
They might think that because it is processed as a PPT, that it is exempt from sales tax, but that is not the case (for anyone). If a FFL gets involved in finding the buy/seller or gets involved in the price, then the FFL has to pay the sales tax, whether they decide to collect it is another story.
The is NO requirement that the business collect the sales tax. There is ONLY the requirement that it be paid by the seller.Kemasa.

Be careful with pawn shops
Turned out this Revolver had a bent ejector rod(they loosened it so it didint show when I tried it) also needed front sight; but 4 hours on the phone and about $150 it is still a good deal; my gunsmith is going to clean and oil thoroughly also,,,,but BE CAREFUL....this is obviously where the really **** guns end up; so look them over carefully!!!!!
